Your response to my request is a little odd

I first asked for emails that contained
'Loan Charge - possible concessions' for March 2019

Your answer - zero

I then widened the scope slightly for the same one month period
'Loan charge'
and the word 'concession' (this may also include the plural 'concessions')
This resulted in an answer invoking section 14 claiming that it would require a disproportionate level of staff effort. You have already demonstrated that extraction of the number of emails is within the limits of section 12. Having read the ICO guidelines on the subject of section 14 I think that you may be applying it inappropriately.

However, I am wondering whether you are using the AND/OR search logic incorrectly. I will adjust my request to determine this

1) How many emails in total for March 2019?
2) How many emails contained the phrase 'Loan Charge'
3) How many emails contained the word concession ?
4) How many emails contained the word concessions ?
5) How many emails contained the phrase 'Loan Charge' AND the word concession?

Thank you for the response using exemption 12.
However I think you must have misread my request.

I asked for the NUMBER of emails with these terms and combinations of the terms specified. You have ably demonstrated that the boolean search is simple to perform as you have stated that

'In line with your request, we conducted a Boolean search of 'Loan charge' and 'concession',
along with 'Loan charge' and 'concessions’, contained in emails from March 2019. This
resulted in a significant number of returns.'

I have not asked for anything other than the number of emails. Let me repeat, NOT the contents of them.

At the very least you could have provided this number as you had already run the query

Please can you respond providing the information requested in FOI2023/00240 which will certainly not exceed the cost of compliance.

I'd like to point out that HMRC have released some emails containing the same subject that I have been asking HMT for. Perhaps of most interest is that some of the emails that they released were from/to HMT personnel.

It confirms that the response you provided to me on 24/10/2022 for FOI2022/18243 was incorrect. You might like to revisit that response and correct it.

Of course you should continue to provide the information solicited in FOI2023/00240.

Dear FOI Requests,

In your response on 3rd March you stated that you were awaiting clarification item 1.
I was indeed asking for the total number of emails , I would have thought it would have been as simple as 'select count (*) ' or an equivalent from your email database. If this would cause significant effort then please provide the answer to the other questions.

Thank you for your follow up response identifying that you had misled me to believe that there were no emails with the subject requested. It appears that there is at least one that has been provided by HMRC. In that respect you can understand why I am now asking for a count of emails with the phrase in various combinations.

Please can you explain what you mean in the following sentence as it appears contradictory

"From this additional search, we can confirm that although HM Treasury holds no emails
containing the phrase ‘loan charge – possible concessions’, we do hold one item
containing the phrase."
