Dear Cardiff and Vale University Local Health Board,

1) I would be grateful if you could send me a list of the terms and
conditions for parking in those car parks covered by CCTV and
managed by Parking Eye at Llandough Hospital.

2) Can you confirm who gets the revenue from legitimate tickets
purchased on site.

3) Can you confirm who gets the revenue from any parking tickets
issued by Parking Eye for alleged offending vehicles.

4) How much is the 'Parking Charge' levied by Parking Eye for
alleged offending vehicles i.e. those deemed to be in breach of the
Terms and Conditions of parking

5) As you are no doubt aware, private parking is based on civil
contract law and any breach of the Terms and Conditions means that
the landowner (or his agent) can recover damages through the civil
court. I would therefore like you to provide me with a copy of the
correspondence or calculations which you as the landowner have
agreed with your agents Parking Eye, as to how you have arrived at
the amount of the Parking Charge levied by Parking Eye for breach
and how that figure represents a genuine pre-estimate of liquidated
damages and/or losses.

I am writing in response to your e-mail below requesting information from
Cardiff and Vale University Health Board under the Freedom of Information
Act.

 

The Freedom of Information Act gives individuals the right to access
official information. The Act allows the right to request any recorded
information held by a public authority, such as Cardiff and Vale UHB.  A
request can be made for any information it is thought a public authority
may hold. The right only covers recorded information which includes
information held on computers, in emails and in printed or handwritten
documents as well as images, video and audio recordings.

 

A request can take the form of a question, rather than a request for
specific documents, but an authority does not have to answer your question
if this would mean creating new information or giving an opinion or
judgment that is not already recorded.

 

As you indicate you are making a request for information under the Freedom
of Information Act the UHB will consider your request in accordance with
the Act and in line with the appropriate guidance issued by the
Information Commissioner as detailed below.

 

The UHB will:

 

• identify which questions amount to requests for information held on
record;

• be ready to offer advice and assistance that is reasonable in the
circumstances; and

• provide a response in line with the requirements of the legislation.

 

I would now like to confirm that your request has been forwarded to the
relevant department to action. A further response will be issued in due
course.

 

As your request is being dealt with under FoI there is a deadline of 20

I am writing to request an internal review of Cardiff and Vale University Local Health Board's handling of my FOI request 'Llandough Hospital parking'.

I am writing further to my e-mail below, apologising for the delay in
responding to your Freedom of Information Act request and providing an
anticipated date for response.

 

As you are aware, Cardiff and Vale University Health Board (UHB) was
unfortunately unable to comply with the anticipated date and a reply was
not issued by Friday 18^th April 2014 and I am very sorry for this. Such
delays are totally unacceptable and I would like to extend an unreserved
apology to you for not complying with the 20 day legislative time scale. I
would also like to offer an explanation for the delay with this request
and finally provide you with a full response.

 

In respect of the delays with responding to your request, this was
partially due to the information not being held centrally and further
exacerbated following a misunderstanding with our authorisation processes.
As soon as it was established that the information you sought was not
centrally recorded every effort was made to obtain the information as
quickly as possible in an attempt to comply with the 20 day timescale.
Unfortunately we were unable to collate the information before the
deadline was reached and notification of this was issued to you on 15
April 2014 (e-mail below). When information was eventually provided to
enable drafting a response the delay in issuing was further compounded due
to a misunderstanding within the UHB authorisation processes. The issues
in respect of the authorisation processes have now been resolved
internally and it is hoped that such delays will not occur in the future.

 

I would now like to confirm that the UHB holds information falling within
the confines of your request and the information that can be provided for
response is attached above.

 

Should you have any queries or need clarification on any aspect of this

Following your correspondence by e-mail, which is attached above, on
Monday 5^th May 2014 seeking an internal review of the way the UHB has
handled your request I would like to confirm that this review request was
forwarded to Mrs Gerrard and a further response in respect of the review
will be issued to you in due course. In addition,  your e-mail (second
attachment above) dated Thursday 15 May 2014 indicates it is your
intention to inform the Information Commissioner of the breach, which you
are quite within your rights to do, however please note the information
provided below which is a standard requirement of the Act.

If you are not content with the outcome of any complaint, you may apply
directly to the Information Commissioner for a decision Generally the
Information Commissioners Office cannot make a decision unless you have
