Littering FPNs

Dear Merthyr Tydfil Council,

1. I understand that the current 3GS littering trial is for 12 months and the trial began on the 1 February 2016, can you confirm the date that the trial will cease?

2. I note that in an earlier response to an inquiry I made to Councillor Roberts, he advised that the MTCBC would encourage a payment plan for those who are of low income and want to pay their FPN’s. Could the Local Authority confirm if they would encourage the setting up of payment plans for those who are of limited means, but wish to pay their FPNs? Can the Local Authority confirm if a system currently exists where an individual of limited means is able to take advantage of a payment plan to pay an FPN?

3. Councillor Gareth Lewis has advised that the littering trial was approved by Cabinet and not full council. Were all Councillors provided the opportunity to discuss, or scrutinise the litter trial proposal? If so, can you provide information about when and where the opportunity arose for all Councillors to scrutinise the littering trail proposal?

4. Can you please advise how many times the Local Authority have amended their littering information page on their website? Can you also confirm that the FAQs page in relation to littering, is still available for public viewing on MTCBC’s website?

5. I note that a number of Councillors have advised constituents that there is an appeals process in place for people to challenge the issuing of FPNs. Did Councillors assume there was an appeals process in place, or where they directly informed there was an appeals process in place?

6. I note that a full equality impact assessment was not undertaken in relation to the 3GS littering trial. In making this decision not to proceed to a full equality impact assessment, was any consideration given to the impact upon particular vulnerable groups, such as those of low income, those with learning disabilities and carers out with disabled people who have littered?

7. I have video evidence of a carer being warned by a 3GS officer that they with be charged with criminal offence, when they attempted to intervene to offer support the disabled person they care for. Has any guidance been offered to 3GS litter wardens about making approaches to disabled people?

8. Have 3GS litter wardens had DBS checks, as I understand part of their role is to provide education to children?

9. Did the Cabinet have access to any of the reports of previous FPN littering trials held in Wales, for example, Vale of Glamorgan and Blaenau Gwent?
