INFORMATION REQUESTS:

1. As requested in the above e-mail please provide me with details of the "other steps being taken" to ensure HE (Highways England) fulfills its duty (on litter under S89 of the Environmental Protection Act) which where referred to in the following e-mail

Where these have been documented please provide copies.

2. Similarly please provide me with copies of any communications from DfT officials to John Hayes MP briefing him on Highways England's responsibilities as regards litter including any communication referring to their statutory duty vis a vis litter after he was appointed as a Minister in the DfT

3. Referring to the penultimate paragraph of the e-mail to Ms Kelly please provide me with copies of the correspondence and other documents, including those evidencing and recording the consultations made and the making of the decision to close the lay-by on the west bound carriageway on A13 in Essex a short distance to the west of it junction with the A1089

If any of this is be unduly burdensome for you please suggest how the load could be lessened and I ill consider modifying my requests

sent on 24 August but I can see you did not receive it – I’m not sure why
it wasn’t delivered.

Dear FOI-ADVICE-TEAM-DFT,

Carly, my policy is to ask the Information Commissioner to issue a Decision Notice whenever a duty body fails to comply with an information request in the statutory 20 working days.

I will delay doing this for a week in case you can provide me with evidence that a response was sent on 24th August as you say it was. Maybe it was accidentally sent in response to a request from another person.

If it was drafted and simply not sent this would not surprise me as it would be the third occasion this has happened to a communication from the DfT to me.

Dear Mr Silverman,

Thank you for your email.

Our FOI recording system shows that the request was closed on 24 August which is where I took the information from in my last email. I wrongly assumed that the response would have been sent on this date, however, I have checked with the team that compiled the response to your request and they confirmed it was not issued on the 24 August.

I am sorry for the delay in sending the response to your request and the misinformation contained within my previous email.
