Litter Enforcement Agents

Response to this request is long overdue. By law, under all circumstances, Craven District Council should have responded by now (details). You can complain by requesting an internal review.

Dear Craven District Council,

1. Are all the litter Civil Enforcement Officers operating in Craven on behalf of Craven District Council direct employees of Craven District Council or are any contracts put out to other companies/organisations?

2. If other companies or organisations do the above work please give me a list of who and how much you pay then ach of them for this. Please also include a list numbering how many direct Craven District Council employees do litter enforcement with their ranks and if possible names and the same for any external companies.

3. What action would Craven District Council take in the instance of a direct Craven District Council employee lying about someone dropping litter?

4. What action would Craven District Council take in the instance of an external company contracted to do litter enforcement fabricating stories about someone dropping litter?

5. How many FPN's were issued in Craven in 2016?

Thank you for your request for information received on 1st February 2017. This request will be dealt with in accordance with either the Freedom of Information Act (‘the Act’) or the Environmental Information Regulations (‘the Regulations’) (whichever is appropriate). You asked for:-

Information relating to litter enforcement agents.

You can expect a reply by 1st March 2017 unless I need to come back either to you to clarify your request or the Council needs more time to deal with your request. In this latter eventuality, for requests dealt with under the Act, delays can sometimes arise where the public interest needs to be considered. In the case of requests dealt with under the Regulations, a delay can arise if the Council believes that the complexity and volume of the information requested means that it is impractical to comply with the request by the date specified, or to make a decision to refuse to do so.

For 3 and 4 you will almost certainly have recorded information as to what you do when an employee falsely accuses someone of something. Please disclose that.

If necessary consider this an internal review request or if you don't want that on your record feel free to answer yourself. I just want the information, don't care what you class this as.

You will have a written HR policy for how you deal with staff who make false allegations against members of the public and customers.

Unless I have misread your answer I also haven't been provided with the job titles/positions of those who can issue FPNs.

I will give you 24 hours to confirm you are going to provide these and if not I will forward this to the ICO.

I need the job titles/positions of those who can issue FPNs and also the policy of Craven District Council for any staff member who lies in order to issue a false FPN.
A more professional reply to an almost identical request was sent here by Leeds City Council. This is the second time in recent weeks that Craven DC have refused to fulfil a simple request.

Stop abusing FOI and WDTK. Craven didn't provide the job titles/positions of those who can issue FPN because you didn't ask for it.
