Lists of remedial works - Dinant Link Road Roundabout
Dear Hertfordshire County Council,
It has been stated by your employee that a "list of all the remedial works" has been provided to the developer of High Leigh Garden village, in regards to the construction works on Dinant Link Road.
I would imagine a list of remedial works was also produced following the 'failed' works in July and October.
Therefore please could provide me with the following:
- The list of remedial works sent to the developer after the works in July, in regards to the works on Dinant Link Road.
- The list of remedial works sent to the developer after the works in October, in regards to the works on Dinant Link Road.
- The list of remedial works sent to the developer after the works in December, in regards to the works on Dinant Link Road.
- The 10 most recent emails between Hertfordshire County Council (Or County Highways) and Lands Improvement Holdings in regards to Dinant Link Road.
- The 10 most recent emails between Hertfordshire County Council (Or Hertfordshire County Highways) and Breheny Civil Engineering in regards to Dinant Link Road.

I am writing to request an internal review of Hertfordshire County Council's handling of my FOI request 'Lists of remedial works - Dinant Link Road Roundabout'.
You stated: "We will respond to your request as quickly as possible, and by close of 06/02/192019 at the latest." Yet is it now 08/02/2019 and you have not replied meaning you may be non-compliant with applicable UK laws.
No response to this request has been received. If a sufficient response is not received within 14 days a complaint with the ICO will be lodged.

Hertfordshire County Council does not hold this information as all
communication was directly with Breheny Civil Engineering

Please note we have redacted in black some of the information in the above
mentioned documents. This is in respect of
Regulation 13 (1) of the Environmental Information Regulations 2004.
This section of the Regulations applies to any requested information which
is personal data, in that it relates to an identifiable person. The
Regulations prevent the County Council from disclosing personal data to
the public if doing so “would contravene any of the data protection
principles”. One such data protection principle (set out in Article 5(1)
of the GDPR), requires that personal data shall be processed “fairly”. In
order to process personal data fairly, the County Council must only handle
it in ways that people would reasonably expect; and not use it in ways
that have unjustified adverse effects on them.
In relation to your request, for documents including emails, the names and
personal contact details of individuals have been redacted. These
individuals would have no expectation we would provide the public with
copies of such personal information.
As part of our consideration we have noted the following Public Interest
Test reasoning:
The public interest arguments for releasing this information are as
follows:
o To release the information would show accountability for the actions
of the Council and its officers
The public interest arguments for withholding the information are as
follows:
o That the public interest in withholding the information outweighs the
public interest in disclosing it.
o Disclosure would be an unfair and unwarranted interference with the
individual’s privacy
On balance we feel the public interest is better served by withholding
this information. As it would not be appropriate, fair or lawful
processing of their personal data and we are consequently satisfied the
exemption also applies to the information you have requested.
Additionally, the County Council’s internal network path has been redacted
in blue from the documents in line with County Council practice. This
does not affect the actual content of the document as the photo files that
were located at the file path have been included as attachments.
Due to the volume and size of documents involved we will be sending these
to you separately via our secure file transfer portal. Please see the
explanation below.
Documents too big to send by email will be sent to you via HertsFX which
is our secure file transfer portal. HertSFX is a fully self-serviced
browser based secure web site purely for transmitting files from HCC to

this information that has been released to me".
Any information request that is considered under the Freedom of
Information (FOI) Act or Environmental Information Regulations (EIR) must
treat all requesters equally, as a consequence a Public Authority should
only disclose information under the Act/ Regulations that they would
disclose to anyone else who asked. In other words, Public Authorities
should consider any information you release under the Act as if it were
being released to the world at large as once a response has been sent then
the requestor that receives that information is free to use that
information in whatever way they deem e.g. share with other individuals,
post on a blog or print in the media etc. The only restrictions on this,
is the supply of documents under the legislation does not automatically
give the requestor or organisation who receives the information a right to
re-use the documents in a way that would infringe copyright. The requestor
who receives the information under the legislation is obliged to respect
the rights of the copyright owner. If they do not, the copyright owner can
seek damages or an injunction for any infringement of copyright. Public
Authorities may advise the requestor if the information requested under
FOI or EIR is subject to copyright protection where known, however it is
the responsibility of the applicant to ensure they do not infringe
copyright.
