Lists of Accessible Taxis under S167 Equality Act 2010

Dear Canterbury City Council,

1) Please advise if you have produced, or currently intend to produce, a list of wheelchair accessible:
a) taxis
and
b) private hire vehicles
under the powers set out in S167 of the Equality Act 2010.

2) Please identify how many a) taxi and b) PHV drivers have applied for medical / physical impairment exemption under S166 of the Equality Act 2010 since S166 was commenced. If you've created a list under S167, please identify how many of the exemptions were in place before S167 and how many have been put in since.

3) Please state whether you voluntarily compiled a list of accessible taxis and private hire vehicles following the Department for Transport's guidance of 15th September 2010, which stated, in relation to section 167, “although the list of designated vehicles will have no actual effect in law until the duties are commenced, we would urge licensing authorities to start maintaining a list as soon as possible for the purpose of liaising with the trade and issuing exemption certificates”. If you did produce such a voluntary list, please indicate when you did so, and provide the current list.

If you have produced a list of wheelchair accessible taxis and/or private hire vehicles under S167, or are going to, please tell me the following.

4) The date the list was instated or by which you intend to do so.

5) The accessibility requirements of a taxi for it to appear on the list.

6) How you intend to enforce drivers' compliance with S165.

Question 1

Please advise if you have produced, or currently intend to produce, a list
of wheelchair accessible (a) taxis and (b) private hire vehicles under the
powers set out in S167 of the Equality Act 2010.

 

Our response:

We do not have a list available to the public but we do have an instantly
accessible database which allows us access to the details of both
companies and drivers.  The reason we don't have a public list is because
this information constantly changes and as such would be out of date
within a matter of days of producing the list.

 

Question 2

How many (a) taxis and (b) PHV drivers have applied for medical / physical
impairment exemption under S166 of the Equality Act 2010 since S166 was
commenced?  If you've created a list under S167, please identify how many
of the exemptions were in place before S167 and how many have been put in
since.

 

Our response:

One taxi driver

 

Question 3

Have you voluntarily compiled a list of accessible taxis and private hire
vehicles following the Department for Transport's guidance of 15th

Our response:

Yes, in 2013 and we also proactively encourage drivers to purchase
wheelchair accessible vehicles. Please see the attached for a list of
Wheelchair Accessible Taxis.

Our response:

The requirements are to be able to take a person seated in the wheelchair.

Our response:

Included in our new policy adopted 12th April 2017, this is attached
above.

I wonder if you could please clarify something for me; I'm unclear on a point in your response. I ask because of a couple of anomalies:

But S167 of the Equality Act was only commenced on 6th April 2017 so it was not possible to have a S167 list before that date...

In section 1.7.2 of your Taxi Policy you state "The sections relating wheelchair users (sections 165 and 167) came into force on 06 April 2017" yet in 1.7.3 you say "When the Disability Discrimination Act 1995 and the Equality Act 2010 provisions relating to wheelchair accessible taxis and PHV’s come into force this policy will be revised."

I'm thus not entirely clear as to whether you do in fact have a current "S167 list" or if it's a voluntary / unofficial list that doesn't have the consequences of being a list held under S167.

Please could you clarify?

Question 1

Is the currently held list of wheelchair accessible taxis a "S167" list
which puts drivers under the obligations set out in S165, or is this still
a voluntary list that doesn't have the obligations of a S167?

Our response:

The council has a list under Section 167 of the Equalities Act 2010.  The
list is a 'live' list and a report detailing the list can be downloaded at
any time. Drivers have to comply with the duties detailed in Section 165.

Since 2013 the council adopted an unofficial list as this promotes
accessibility to all.
