Lists of Accessible Taxis under S167 Equality Act 2010

Dear West Oxfordshire District Council,

1) Please advise if you have produced, or currently intend to produce, a list of wheelchair accessible:
a) taxis
and
b) private hire vehicles
under the powers set out in S167 of the Equality Act 2010.

2) Please identify how many a) taxi and b) PHV drivers have applied for medical / physical impairment exemption under S166 of the Equality Act 2010 since S166 was commenced. If you've created a list under S167, please identify how many of the exemptions were in place before S167 and how many have been put in since.

3) Please state whether you voluntarily compiled a list of accessible taxis and private hire vehicles following the Department for Transport's guidance of 15th September 2010, which stated, in relation to section 167, “although the list of designated vehicles will have no actual effect in law until the duties are commenced, we would urge licensing authorities to start maintaining a list as soon as possible for the purpose of liaising with the trade and issuing exemption certificates”. If you did produce such a voluntary list, please indicate when you did so, and provide the current list.

to implement a list on our website in the future - we are looking into
what our public register can provide.

You responded:

You said you do intend to produce a list. As I said "or are going to", I'd have hoped in Q4 you would give some indication as to within what period you hope to be able to produce a S167 list. Similarly on Q5 and Q6, I wanted to know of any definition you have in mind for WAV vehicles, and any idea you may have as to how you intend to enforce S165.

I am writing to request an internal review of West Oxfordshire District Council's handling of my FOI request 'Lists of Accessible Taxis under S167 Equality Act 2010'.

I said:

You responded:

Dear Mr Paulley,

 

I note that you have asked the Information Commissioner’s Office to look
into West Oxfordshire District Council’s failure to respond to your
request for information about accessible taxis under the Freedom of
Information Act and carry out an Internal Review.

 

I responded to your request for an Internal Review on 26^th May 2017. My
response covered both Cotswold and West Oxfordshire District Councils as
the licensing operations for those councils are run by the same joint
team.  A copy of my response is attached, though it was sent from a
Cotswold DC email address which may have caused confusion.   We had hoped
that this response would provide you with sufficient information and
explained why we felt that a formal Internal Review was unnecessary. If
there is any further information or clarification which you need please
let me know and I will endeavour to obtain it for you.
