Lists of Accessible Taxis under S167 Equality Act 2010

Dear Melton Borough Council,

1) Please advise if you have produced, or currently intend to produce, a list of wheelchair accessible:
a) taxis
and
b) private hire vehicles
under the powers set out in S167 of the Equality Act 2010.

2) Please identify how many a) taxi and b) PHV drivers have applied for medical / physical impairment exemption under S166 of the Equality Act 2010 since S166 was commenced. If you've created a list under S167, please identify how many of the exemptions were in place before S167 and how many have been put in since.

3) Please state whether you voluntarily compiled a list of accessible taxis and private hire vehicles following the Department for Transport's guidance of 15th September 2010, which stated, in relation to section 167, “although the list of designated vehicles will have no actual effect in law until the duties are commenced, we would urge licensing authorities to start maintaining a list as soon as possible for the purpose of liaising with the trade and issuing exemption certificates”. If you did produce such a voluntary list, please indicate when you did so, and provide the current list.

If you have produced a list of wheelchair accessible taxis and/or private hire vehicles under S167, or are going to, please tell me the following.

5) The accessibility requirements of a taxi for it to appear on the list.

10. Purpose Built Vehicles (approved by the Public Carriage Office and
Wheelchair Accessible Vehicles Age Policy) Purpose Built Vehicles and
wheelchair accessible vehicles must be less than 6 years old from the date
of first registration when first licensed by the Council and provided that
they continue to meet the vehicle specifications may continue to be
licensed up to, but not including, the date that the vehicle is 12 years
old from the date of first registration. Wheelchair accessible vehicles
not fitted with a mechanical lift must, at all times, carry the correct
passenger ramps stamped with their safe working load. The vehicles must,
at all times, carry wheelchair tie downs compatible for the safe securing
of the wheelchair and the correct restraint for the user. All electric
wheelchairs must be secured with four point tie downs.

 

14. Disability Access Where a vehicle is used for the carriage of disabled
passengers in a wheelchair or with an infirmity, the following conditions
shall apply: · Access to and exit from the wheelchair position must not be
obstructed in any manner at any time except by wheelchair loading
apparatus; · Wheelchair anchorage must be of the manufacturer’s design and
construction and secured in such a position as not to obstruct any
emergency exit; · A suitable restraint must be available for the occupant
and the wheelchair; · Access ramps must be securely fitted prior to use
and be able to support the wheelchair and occupant and helper; · Ramps,
lifts and steps should be part of the vehicle as manufactured or adapted
and must be securely stored in the vehicle before it moves off; ·
Passengers in wheelchairs must not travel in a sideways position; · Any
provisions to enable disabled access operate correctly in accordance with
manufactures guidance; · All equipment must be maintained in good working
order and be available for use at all times; · The driver of any vehicle
should have sufficient training in loading and conveying wheelchairs
passengers.
6) How you intend to enforce drivers' compliance with S165. By continued
