Dear Leisure and Culture Dundee,
1. Please list all public swimming pools that provide 'women only' or 'ladies only' (or similarly described) swimming sessions within your leisure centres.
2. Which of the listed facilities that advertise 'women only' or 'ladies only' (or similarly described) swimming sessions, provide an environment that is exclusively single sex, i.e., for females only, and which facilities provide a session that is mixed sex, i.e., do not exclude males who identify as a woman?
3. Please send me a copy of the policy or policies that cover the provision of 'women only' or 'ladies only' (or similarly described) swimming sessions.
4. Please tell me, do your leisure centres and sports facilities provide single sex changing rooms and showers ?

Please find below the response to your questions,
1. Please list all public swimming pools that provide 'women only' or
'ladies only' (or similarly described) swimming sessions within your
leisure centres.
A weekly women only swim session is hosted at Lochee Swimming and Leisure
Centre
2. Which of the listed facilities that advertise 'women only' or 'ladies
only' (or similarly described) swimming sessions, provide an environment
that is exclusively single sex, i.e., for females only, and which
facilities provide a session that is mixed sex, i.e., do not exclude males
who identify as a woman?
The women only session at Lochee Swimming and Leisure Centre is an
exclusively single sex provision for females only. We do not currently
have a session for - mixed sex that do not exclude males who identify as a
women.
3. Please send me a copy of the policy or policies that cover the
provision of 'women only' or 'ladies only' (or similarly described)
swimming sessions.
These sessions meet the criteria under the Equality Act 2010 subsection
'Providing services to people with a particular protected characteristic'
which states:
You are allowed to provide separate services for men and women where
providing a joint service (i.e. one where men and women are provided with
exactly the same service) would not be as effective. You are also allowed
to provide separate services for men and women in different ways or to a
different level where:
• providing a joint service would not be as effective, and
• the extent to which the service is required by one sex makes it not
reasonably practicable to provide the service except in the different
ways or to the different level.
In each case, you need to be able to objectively justify what you are
doing.
You are allowed to provide single-sex services (services just for men or
just for women) where this is objectively justified and:
• only men or only women require the service, or
• there is joint provision for both sexes but that is not enough on its
own, or
• if the service were provided for men and women jointly, it would not
be as effective and the extent to which each sex requires the service
makes it not reasonably practicable to provide separate services for
each sex, or
• the services are provided in a hospital or other place where users
need special care, supervision or attention (or in parts of such an
establishment), or
• the services may be used by more than one person at the same time and
a woman might reasonably object to the presence of a man (or vice
versa), or
• the services may involve physical contact between a user and someone
else and that other person may reasonably object if the user is of the
opposite sex. For example:
◦ At a commercial gym and swimming pool, women-only swimming sessions
could be provided as well as mixed sessions.
◦ Separate services for men and women could be provided by a beauty
therapist where intimate personal health or hygiene is involved
◦ A healthcare provider can offer services only to men or only to
women, such as particular types of health screening for conditions
that only affect men or only affect women.
4. Please tell me, do your leisure centres and sports facilities provide
single sex changing rooms and showers ?
Our leisure centres used for public swim access all have mixed sex
changing facilities with shower cubicles for individual use.
Your Right to Appeal
If you are unhappy with this reply you may require Leisure and Culture
Dundee to review its actions and decisions in relation to your request.
The requirement for review must:-
· be in writing or other permanent form (please address it to the
Director, Leisure and Culture Dundee, Central Library, The Wellgate,
Dundee, DD1 1DB);
· state your name and give an address for correspondence;
· specify the original request for information and the matter which gives
rise to your dissatisfaction; and
· be made within 40 working days of the date of this response, although
Leisure and Culture Dundee may, if it considers it appropriate to do so,
consider requirements for review after that time has passed.
Your requirement for review will be dealt with by the Director of Leisure
and Culture Dundee. She will reply to you in writing promptly and in any
event within 20 working days. She may:-
· confirm my decision with or without modification
· substitute a different decision for my decision
and will give you her reasons for so doing.
If you are unhappy with the Director's decision you may then appeal to the
Scottish Information Commissioner. You must submit your appeal to the
Scottish Information Commissioner within six months of receiving the
Director's decision. Further details on the Scottish Information
