List of responses to consultation on costs protection in defamation and privacy claims

Dear Ministry of Justice,

This is a Freedom of Information request. It is a follow up to a request I made on 16 July (your ref 210716015) which was refused on grounds relating to s.40 of the FOI Act 2000.

I plan to ask for an internal review of the refusal of this earlier request. I believe the Ministry could have supplied some of the information, and/or redacted information.

In the meantime, I am making a slightly different request regarding the same information.

The request:

In 2013, the Ministry of Justice ran a consultation on costs protection in defamation and privacy claims. See here: https://consult.justice.gov.uk/digital-c...
The government only completed the consultation 29 November 2018, when a policy was announced.

Please supply an itemised list of all the responses to the consultation, giving the name of the individual or organisation responding. My previous FOI request confirmed that the Ministry still holds this information.

For the avoidance of doubt, this is not a request for the responses themselves i.e. it is not substantially the same request as that previously refused. In this request I am just asking for a list of the organisations and individuals who responded to the consultation.

I note that s.16 of the Freedom of Information Act 2000 places a duty upon the Ministry to provide “advice and assistance” to people making a request. Part of my dissatisfaction with the response to my earlier request was the cursory refusal to provide any information, when an official could have contacted me to explain in more detail what information could be provided while abiding by the terms of s.40. So if there are any challenges or s.40 issues in servicing this new request, I would appreciate a response that delineates what information could be provided, and recommendations for how best to word a refined request.

Dear Ministry of Justice,

I write with an addendum to the above mentioned FOI.

In the request I complained at the paucity of the response to a previous request. I note with a degree of embarrassment that I had misread the response to the earlier request! The What Do They Know system displayed only the Ministry’s response letter, and not the redacted attachments. Reviewing that request again, I realise that more information had been provided than I had thought.

I would, however, like to leave this current request open for a response. The earlier request did not conclusively state whether or not any responses had been withheld in their entirety. A schedule of all responses would be helpful in clearing that up.
