Thank you for your Freedom of Information request relating to the possibility of obtaining from The National Archives a ‘list of ACT's & Statutes which have been removed’. Unfortunately before we are able to process your information request further I would be grateful if you could clarify the following points:

1. The term ‘removed’; should this be taken as repealed?

2. A timeframe

3. Confirmation on the terms ‘Acts and Statues’; should this be taken as Primary legislation (Acts) and secondary legislation (SIs)? It should be noted that Acts and Statues are the same.

In line with the terms of the Freedom of Information Act (2000) the 20 working days deadline afforded to us has stopped ticking and will not resume until we have received confirmation from you on the above points. You may however wish to visit the website www.legislation.gov.uk. The ‘changes to legislation’ functionality may assist you further in your research. Additionally the Chronological Table of the Statutes, which are available from the National Archives Library or any law library, may also be of interest to you. Finally if legislation is repealed the reason for this is not held by The National Archives; individual government departments would be better placed to advice on the reasoning behind why legislation was repealed.

Should the above advice satisfy your information request I would be grateful if you could contact me again in order for me to update the status of your request - which please again note is ‘on hold’ with no further action being taken until the re-framing questions are confirmed by you. Thank you for this list, but what is the list of. Repealed from legislation or simply removed from the site as I know of some 'acts' & 'si' which have been removed from the site.
It is those of which I am interested in, not 'repealed', but removed from the legislation.gov site.

Thank you for your email. I am sorry for any confusion or delay caused. I can therefore confirm that the information provided to you relates to Secondary Legislation (as no Acts where removed) which has been removed from the Legislation.gov website. This information was provided in-line with the additional information provided by you in your response to our re-framing question relating to this request.

As previously explained Acts or Secondary Legislation which are formally repealed would still remain on the Legislation.gov website.

For example the Terrorist Asset-Freezing (Temporary Provisions) Act 2010 has been repealed but remains on the website (with a note saying it is repealed) in order to offer as complete a record as possible.

Again I trust this information is of some use to you.

I do not believe you have supplied me with all the information I requested as I have searched through the information you previously supplied and I could not find 'Local Government Act 1933'.
I require a list of ALL Act's & SI which were previously available on legislation.gov, I require a list of those which have been removed and those which have been repealed and removed. I apologise for the confusion.

Thank you for your email with regards to further information relating your recent Freedom of Information request. I have again contacted our Legislation Team and they have been able to provide the following additional clarification:

"Legislation.gov.uk carries all legislation published from 1988 onwards. Prior to that the site contains (with a few exceptions) all primary legislation that was at least partially in force from 1st February 1991. Acts that were wholly repealed before 1st February 1991 are not necessarily carried on the website. Further information about what is and isn't held on the website can be found on the Help pages - http://www.legislation.gov.uk/help#about...

The help pages of legislation.gov.uk contains a section on how to access legislation that isn’t on the website – please see http://www.legislation.gov.uk/help#about...

I trust these two links detailing what information is held on the website and details on how to access information which is perhaps not held is of some use to you and I wish you all the best with your research.

You requested a list of items that have been removed from
legislation.gov.uk and, because these items have been removed, they are
not available to view online.

 

Many of the instruments that were removed have since been replaced and the
latest versions of those pieces of legislation are available online.

 

The clarification supplied in the previous email details why some pieces
of legislation are not available and have never appeared online. Such
items have not been removed.

Dear National Archives,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of National Archives's handling of my FOI request 'List of removed ACT's & Statutes'.

I have requested a list of Act's & SI's which have been removed from the site'legislation.gov and all I was given is what you can see in the corespondence between me and The National Archives. I know of some which have been removed but I am actually unable to locate them from where I am told to look, one is the Magna Carta 1215, another is an act from 1933, which is also unobtainable.
I even made the request a lot clearer by asking for a list of ALL Act's & SI'. This has failed to be actioned.
I also mentioned that the site I was told to search for Act's & SI's I wanted, I could not obtain ANY information I required as I was unable to actually download or even see ANY search results I searched for, which was an Act or SI.

Review of complaint about access request: Appeal by Mr Maddison against The National Archives’ handling of a request for information under the Freedom of Information Act 2000 regarding a list of removed ACTs and Statutes.

We wrote to you informing you that we would review and respond in writing to your request for an internal review by 24 January 2017.

Your appeal is still being considered and I have not yet finished my review.

I anticipate being able to respond with my final decision within 40 working days from the date of receipt – that is to say, on or before 21 February 2017. This is in accordance with the Code of Practice on Internal Appeals:
