List of public roads

We're waiting for Jade Harris to read a recent response and update the status.

Dear Walsall Metropolitan Borough Council,

I would like a list of public roads in Walsall please? In order to advise a client further I need to know whether a certain road is a public/private/restricted road.

I can be more specific if you are able to help with this enquiry however this information may be useful and of assistance for the general public.

Walsall Council is working extremely hard to ensure the safety and
wellbeing of all residents of the borough during this difficult period. As
part of this working practices and priorities within the council may need
to change in line with advice from the Government and our own Public
Health Service.

Further to your request for information List of public roads , received
on 16 November 2020, I am writing to ask for some further clarification of
some aspects of your request.

 

In order for us to process your request as fully as possible could you
please provide the following information:

Please can you specify the name of the road refer to in your
request as 'a certain road' which road, whilst we are happy to provide
you with a complete list of all public roads within the Walsall MBC
area, if we know the name of the road you are referring to we can
further confirm its status

The Freedom of information Act 2000 allows the council 20 working days in
which to respond to requests.  However, this “clock” stops should we need
to seek clarification in order to locate or identify relevant
information.  As such, your request is now on hold until we receive the
clarification requested.

If you wish to proceed with this request please send your clarification to
us, quoting the above reference number.

The "road" in question is referred to as "the black stretch", what is believed to be a public footpath, between Station Road and Whateley Road in Walsall. All "roads" mentioned here including the Black Stretch in particular would be important to us to be clarified.

Further to your request for information about a List of all Public Roads
within the Walsall MBC area which we initially received on 16th November
2020 and then further clarified on the 29th November 2020 as being
specific to a public footpath known locally as 'The Black Stretch' that
was situated between Station Road & Whatley Road, in Walsall, please refer
to that attached map in conjunction with the information provided below:  

 

The road referred to in your request as the 'Black Stretch' believed to be
a public footpath between Station Road and Whateley Road in Walsall,
whilst we have not received a copy of the map referred to in your enquiry
based on the location description provided we have identified a footpath
known as footpath 40.

 

Please note that footpath 40 is situated between the two roads detailed
in your request, namely Station Road and Whateley Road, however there is
no reference on the definitive map and statement to any roadway known
as the Black Stretch in the vicinity of this area, and therefore based our
response accordingly. 

 

We can confirm: -

All roads and highways which are maintainable at public expense within the
Whateley Road and Station Road area are shown shaded in brown on the
attached map. There are no additional roads shown on Highway records
further to these.

Our records show a public right of way recorded on footpath 40 on the
definitive map and statement which runs between Whateley Road and Station
Road. The attached map shows the right of way, confirming the alignment of
this footpath as shown on our records highlighted in green.

This public right of way is classified as a public footpath and so has
pedestrian rights over it and although part of it is obstructed towards
Station Road, no stopping order has been completed, so these public rights
of way remain in existence.

 

Additionally, in accordance with s.31 of the Highways Act 1980, where a
route has been enjoyed by the public for a period of 20 years or more
there may be sometimes unrecorded public rights of way in existence.
However no such claims or evidence have been received or presented to
the council in relation to this.
