"This data controller states that it is a public authority under the Freedom of Information Act 2000 or a Scottish public authority under the Freedom of Information (Scotland) Act 2002"

Dear Mr Cross

I am writing further to my colleague’s acknowledgement dated 1 February
2010 and in response to your request for information also made on 1
February 2010. This has been dealt with in accordance with the Freedom of
Information Act 2000.

In your email you referred to the register of data controllers and where
data controllers state that they are a public authority. You asked;

“Please could you provide me with a list of the controllers who have (so
far) indicated that they are public authorities on their return.”

You furthermore asked for this information in CSV format, including
addresses, registration numbers and any other codes/reference numbers.

This information is exempt under section 21 of the Freedom of Information
Act 2000 which states;

“21.-(1) Information which is reasonably accessible to the applicant
otherwise than under section 1 is exempt information.”

The register is available online for free and is provided as part of this
office’s publication scheme. The information requested is contained
within the information provided online.

However, we appreciate that in order to extract the information you
require you would need to perform separate searches online using postcode
information, or another identifier, in order to check every entry in the
register (which would be extremely time consuming). Therefore, to provide
assistance we have provided a complete list of the data controllers who
have stated that they are a public authority when notifying. This list has
been provided in CSV format and includes names and reference numbers. Any
further information can be obtained by [2]searching the online register
using the details provided.

I would stress that this list is only based upon the information provided
to us, and is not an authoritative list. You should also be aware that the
register changes on an almost daily basis and so this list constitutes a
snapshot in time.

I hope this information is helpful. If you are dissatisfied with the
response you have received and wish to request a review of our decision or
make a complaint about how your request has been handled you should write
to the Internal Compliance Team at the address below or e-mail

Your request for internal review should be submitted to us within 40
working days of receipt by you of this response. Any such request
received after this time will only be considered at the discretion of the
Commissioner.

If having exhausted the review process you are not content that your
request or review has been dealt with correctly, you have a further right
of appeal to this office in our capacity as the statutory complaint
handler under the legislation.  To make such an application, please write
to the Case Reception Team, at the address below or visit the
‘Complaints’ section of our website to make a Freedom of Information
Act or Environmental Information Regulations complaint online.

Dear Information Commissioner’s Office,
Thank you for the information you released in response to my request. It will be very useful for my volunteering work and as it is published online I am sure others will find it useful to.

I accept that you are not responsible for the accuracy of returns. Please be aware however that a number of political party constituency organisations have indicated that they are public authorities it would appear to me unlikely that they are.
