Dear Health and Care Professions Council,

I would like to request a list of all psychologists, both current and former, that are, or have been, registered with either the British Psychological Society or Health and Care Professions Council that have had a complaint made against them.

When I enquired about the information from the British Psychological Society I was informed that I would need to make this request to the Health and Care Professions Council -

Thank you for your email of 18 October 2017, in which you ask for a list
of all HCPC registered psychologists that have had a complaint made
against them.

 

Your request has been handled under the Freedom of Information Act 2000
(FOIA).

 

We make available an advanced hearings search that allows you to search by
profession for final hearing cases. This is available on our website at
[1]https://www.hcpts-uk.org/hearings/search. We also publish the names of
registrants who are subject to upcoming hearings. This is available at

We are unable to release the names of registrants that have complaints
made against them that are not at [3]final hearing stage. This is because
we consider this to be the personal data of the registrant and is
therefore exempt from disclosure under Section 40(2) of the FOIA. Further
information on this exemption is provided below.

 

Section 40

 

The exemption in Section 40(2) of the FOIA applies to personal data which
relates to a third party. Disclosure of the names of registrants that have
complaints made against them where our investigation is not at the final
hearing stage, would breach the principles of data protection set out in
Schedule 1 of the Data Protection Act 1998. In particular the first
principle, that personal data should be processed fairly and lawfully.

 

This information forms the personal data of registrants who would not
expect the HCPC to disclose this information to a third party for this
purpose.
