Dear Competition Commission,

This is a Freedom of Information request for a list of metered estates in England and Wales.

I believe that the Competition Commission holds this information as it would have been necessary when considering the matter of the domestic bulk LPG market (which eventually led to the Domestic Bulk Liquefied Petroleum Gas Market Investigation (Metered Estates) Order 2009).

Please provide for each metered estate:

* The name and location of the estate
* The type of fuel
* The name of the incumbent supplier
* The number of households and/or businesses served

If only a subset of this information is held, please provide only this subset. If no specific information is held, please provide any data held about metered estates.

A metered estate is an estate where a customer is supplied with LPG, or other heating fuel, using a tank or tanks and pipework which supply more than one customer and where customer consumption is individually measured by a dedicated meter.

Thank you for your email to the Competition Commission (CC).

The CC does not hold information on metered estates, other than information obtained for the purposes of our market investigation into Domestic bulk liquefied petroleum gas, which was carried out between 2004 and 2006.

However, you will see that much of the detailed information has been redacted from these publications, in accordance with Part 9 of the Enterprise Act 2002, and in particular section 244 of that Act.

We are unable to release information about metered estates which has not been published on the CC's investigation website. This is because such information falls under the following exemptions set out in sections 32(2) (a) and (b) and section 44 of the Freedom of Information (FOI) Act 2000:

Information is exempt from disclosure if it is held only by virtue of being contained in:
i) a document given to the CC for the purpose of an inquiry (FOI Act section 32(2) (a));
ii) a document created by the CC for the purposes of an inquiry (FOI Act section 32(2) (b)).

Information is exempt from disclosure if its disclosure is prohibited by any statute (FOI Act section 44(1) (a)). Section 237 of the Enterprise Act 2002 prohibits the CC from disclosing specified information relating to an individual or company which was obtained in the course of an inquiry unless the disclosure is permitted under Part 9 of the Enterprise Act, in particular, under section 244.
