In response to your request for information received at this office on 03
February 2020 , please see the councils response below.
You requested
I would be grateful if you would send me a list of the
addresses for current HMO licensed properties in the Bolton area including
the name(s) and correspondence addresses of the owners.
Our response
Bolton Council has considered your request and feels that the
information you request is exempt from disclosure under the Freedom of
Information Act 2000 (“the Act”).
Section 17 of the Act provides that when refusing a request, Bolton
Council must provide a notice which (a) states that fact, (b) specifies
the exemption in question, and (c) states (if that would not otherwise be
apparent) why the exemption applies.
In this case, we consider that the exemption under section
21(2)(b) of the Act applies which states where there is a legal duty to
make information available, it can be considered to be reasonably
accessible to the applicant, whether or not payment is required.
The provision applies if the information is available either from the
public authority receiving the request, another public authority or indeed
any other person.
The information is available on request under the Housing Act 2004.
Section 232 of the Housing Act 2004 states that every local housing
authority must maintain a register of licences for houses in multiple
occupation (HMO) (subsection (1)). The register must contain prescribed
particulars (which, by virtue of SIs 2006 No.373 and 2007 No.1903, include
the name and address of the licence holder) (subsection(3)), it must be
made available for inspection (subsection (4)) and a copy of the register
(or an extract) must be supplied, subject to payment of a fee, on request
(subsection (5)).
Under the Housing Act 2004 there is no obligation to make the register
available electronically however arrangements can be made to view the
register or receive a hard copy in the post (a fee may be payable). Please

Therefore Section 21(2)(b) is applicable and this email constitutes a
refusal notice for your request under the Freedom of Information Act 2000
