List of HMO's in your area

Dear Teignbridge District Council,
Under the FOI Act.
Could you provide me with the full list of HMO,s in you area.

And provide me with the full list of HMO's that are required to be licenced and provide a list of those that need a licence but do not have one.

Should it be deemed that in providing me those lists for your area the cost eliment would come into play, could you please only provide a list for the Teignmouth, Dawlish, Starcross, Exminster and Kenford area.

Thank you for your Freedom of Information Request.  Please note that the
Council offices are closed from 5.00 p.m. on Wednesday, 23 December and
will re-open on Monday, 4 January 2016.  If your request is received
within these dates and if it is deemed valid, the 20 working days to
calculate a response will be from Monday, 4 January subject to the
information not being exempt from the provisions of the Act.

firstly finding the information, the first £450 of this cost is not
chargeable, secondly disbursements, this includes costs for items such as
photocopying and postage. This will be considered and you will be informed
if a fee is payable. In this event the fee must be paid before the
information is processed and released. The 20 working day time limit for
responses is suspended until receipt of the payment.

Hmmm.

Apparently only 13 HMOs in Teignbridge District - this is low cf. East Devon where there are many more in Exmouth alone, but that might just be the demographics being different.

Their grounds for withholding information about licensing is dubious IMO. The register of electors is a publicly viewable register, so the names of the tenants might be public information anyway. But you did not ask for them to disclose personally identifiable data like names, so the DPA does not apply; the license is for the property not for an individual, so the DPA does not apply; the license will be held by the owner of the property rather than the tenants who live there, and the owner is not identifiable from a public source AFAIK, so the DPA does not apply. Therefore their public interest test (which relied upon the DPA) fails, and they should disclose the information.

I have not looked at Section 30 recently so I am unclear about whether this would apply. However, it does sound like they have a genuine intent to publish (which if memory serves me was one of the criteria for Section 30). I recommend you review Section 30 and see if it seems to apply or not.
