Thank you for your email of 30 September 2022, in which you asked for:
‘a list of all firms and financial advisers who hold the advising on
investments permissions in accordance with the regulated activities
requirements. The list should include full address and contact details for
each advising on investments permission.
Please make every effort to provide the information requested within the
required 20-working day period’.
We are processing your email as a request in line with the provisions of
the Freedom of Information Act 2000 (FOIA).
We apologise for contacting you at this late stage, but it is not clear
from your email exactly what information you require. The ‘Advising on
Investments permission’ is a broad permission which will have limitations
attached to specify the customer type and investment type the permission
applies to. To help us deal with your request, please can you clarify
whether you are interested in receiving information on firms who provide
retail investment advice to retail customers or all firms with the
Advising on Investments permission regardless of customer and investment
type.
By way of assistance, we would like to explain that individuals do not
hold permissions to carry out regulated activities. This is because the
firms the advisers are employed with would hold the relevant permissions
in order for them to be able to carry out the specified regulated
activities.
Finally, please clarify if you would like to receive full address and
contact details for firms holding either of the above described
permissions.
If you are also after information on individuals at those firms, we would
like to advise that we do not hold full address and contact details for
advisers, and we are unlikely to be able to provide the names of the
individuals as an exemption is likely to apply.
We will be unable to proceed with your request until we receive sufficient
clarification of the information you are seeking.
The Information Commissioner's Office (ICO) has issued the following
guidance on interpreting and clarifying requests:
"A clarified request represents a new request for information. If the
requester subsequently provides enough detail to enable you to identify
and locate the information, then you must respond within a new 20 working
day time limit. The ‘clock’ starts the day after you receive the
clarification.”

The 20 working day period will therefore commence once we have received
sufficient clarification to allow us to deal with your request. If we do
not receive the further information we have asked you for within 40
working days of the date of this response, we will close this request.

Thank you for your message.
I wish to receive information on all firms advising on investments permissions (regardless of type). I think this was sufficiently clear as no sub-division was indicated or specified. so I don't understand why there was any need to assume anything other than what was stated.
I had already requested full address and contact details for firms holding the permissions as noted above.
Whilst I note your apology, I am concerned as to why it was felt necessary to query the above points rather than apply a reasoned approach based on the literal interpretation of the request. Furthermore, I am concerned that you waited until the last possible day to ask the question, and you have done this before. This is not consistent with the guidance to contact requesters as soon as possible within the 20 days, i.e. rather than constantly waiting until the 20th day.

Thank you for your email of 30 September, and your further email of 29
October 2022 in which you clarified you are after information on any firm
advising on investments permissions.
Please see below Annex A for the FOI requests within your emails.
We have processed your emails in line with the provisions of the Freedom
of Information Act 2000 (FOIA) and our response is attached on Annex B.
We have extracted this data from the Financial Services Register, and is
based on firms which currently hold at least one of the following
permissions which make up the Advising on Investments Regulated Activity:
• Advising on Peer to Peer agreements
• Advising (ex Pension Transfers/opt outs)
• Advising on Pension Transfers/opt outs
As explained in our email of 28 October 2022, individuals do not hold
permissions to carry out regulated activities. This is because the firms
the financial advisers are employed with would hold the relevant
permissions for them to be able to carry out the specified regulated
activities.
