Thank you for your email dated 18 January 2022 requesting a list of all
doctors struck off from the Medical Register between 01/01/2015 -
31/12/2021 who appealed under section 40 of the Medical Act 1983. I have
considered your request under the Freedom of Information Act 2000 (FOIA).

 

I have interpreted your request to mean doctors that have appealed their
erasure from the medical register. Between 1 January 2015 to 31 December
2021, 41 doctors have appealed their erasure under s.40 of the Medical Act
1983.

 

However, I’m unable to provide you with a list of the actual doctors that
have appealed their erasure. This is because it is the personal data of
the individuals involved. I’ve given details of the exemption under the
FOIA which applies below.

 

The exemption

 

Section 40(2), by virtue of section 40(3A)(a) is an exemption that applies
where the information is the personal data of a third party and where
releasing the information would breach any of the principles relating to
the processing of personal data listed at Article 5 of the General Data
Protection Regulation (GDPR). In this instance disclosure would breach the
first principle, which requires the processing of information to be
lawful, fair and transparent. I do not believe that any of the legal bases
for processing listed at Article 6 of the GDPR are met and therefore
giving you the information would be unlawful.

i shall be content with similar information FOR ALL THAT WERE ERASD BETWEEN 2015 AND 2021.

This request did not respond to the aspect that will allow tracking of these doctors. I am a doctor who has written about my issues and sent it for publication in BMJ OPEN. It analyzed cases of doctors who were Erased from the register and who appealed the decision. My case was Onwude v GMC 2017 EWHC 601 (601) and i won my appeal.

This is active injustice by a bad GMC against doctors where the GMC have applied for punitive court extensions restricting employment. The concern not properly highlighted is action is not actually in the public interest but to allow non-medical staff (and employed incompetent legal staff) incompetent at investigating to slowly continue investigating. Clearly compensation for loss of earnings as set out in the Medical Act 1983 (as amended) should be paid but will not, as the GMC are more keen to pay non-doctor staff extortionate salaries and charity tax-cheats/QCs to persecute doctors only.

The GMC should apply Rule 12 or act on behalf of all these doctors - which is would have if it treated doctors fairly (last century) but now will not and make up excuses to prevent justice.

This is work that should clearly have been already been done by the GMC and should not need a Good Samaritan doctor to do the work for them.

Mr Onwude, please consider contacting the BMA and Human Rights organizations to take further just action against the unfit for purpose GMC. I would say ask your MP
to then contact the Parliamentary Health Service Ombudsman and weakling-PSA but the the GMC is no longer elected but appointed by a questionable system which has its own problems.
