Thank you for your email dated 30 May, in which you ask for a list of all
doctors who have either been erased or suspended from the GMC register
between 01/01/2018 and 31/12/2018. I’ve considered your request under the
Freedom of Information Act 2000 (FOIA). I am sorry for the delay in my
response and any inconvenience this may have caused you.

 

I have attached a list of doctors who have received a suspension (as a
final sanction) or erasure from the GMC register for fitness to practice
reasons between 1 January 2018 and 31 December 2018. This list does not
include interim suspensions (while an investigation is ongoing) or
immediate (during the appeal period after a final sanction has been
imposed).

 

The names of some doctors who received sanctions within this time period
have not been included. This is because we only publish details in line
with the time limits set out in our disclosure policy- please find it
here:

In relation to the names of doctors whose details are no longer published,
we consider the following exemptions listed in the Freedom of Information
Act 2000 to apply and therefore the information is exempt.

 

The exemptions

•           Section 40(2), by virtue of section 40(3)(a)(i) - This
exemption applies where the information is the personal data of a third
party and where releasing the information would breach any principle of
the DPA. In this instance disclosure would breach the first principle of
the DPA, which requires the processing of information to be 'fair and
lawful'. I believe the conditions in Schedule 2 of the DPA, which are
about the processing of personal information, are not met and therefore
giving you the information would be unlawful.

•           Section 31(1)(g) leading to section 31(2)(d) - This relates to
information which, if disclosed, would be likely to prejudice our
regulatory function. This exemption is subject to a public interest test.
In this case I believe that the public interest in withholding this
information outweighs the public interest in disclosure.

 

Your right of appeal

You can appeal my decision to apply the above exemptions.  If you would
like to do so please set out your reasons in writing to [1][GMC request email].
Please note that we will only usually consider appeals received within 40
working days of our response. You can also appeal to the Information
Commissioner, the regulator of the FOIA and DPA.
