Dear Oldham Borough Council,

I am looking for a list of long term empty property lists within
the councils area. Would you be able to supply me with these under
the Freedom of Information Act? A spreadsheet will suffice, I
require no personal information simply the property address.

Dear Mr Younis,

 

I write in response on behalf of the council to your request under the
Freedom of Information Act 2000 dated 20th December 2013, which read as
follows:

 

I would like a list of empty properties (not business properties) which is
what you have supplied in my [original] request.

 

The council currently owns four residential properties: no. 2, 2a, 4 & 10
Norfolk Street, Werneth. These properties, however, are in the process of
being disposed to raise funds for future regeneration of South Werneth.

 

The council has decided that it should not supply you with details of any
premises owned by others. In deciding not to release all of the
information to you the council relies on section 31 of the Freedom of
Information Act 2000, which states that information is exempt information
if its disclosure would, or would be likely to, prejudice the prevention
of crime.

 

The council has considered the criminality that could reasonably be
anticipated as realistic possibilities arising from disclosure of the
addresses in question. This point applies to all empty properties
including those owned by the council but there is a balancing exercise to
be conducted when deciding whether this information should be released in
the public interest and the rights of individuals and others to respect
for the privacy and their property also come into consideration.
