I would like to make a request under the Freedom of Information legislation for a list of Elderly Care Homes within your geographical remit that are currently under restrictions or bans of placements (patients/residents) where the cost of care is borne by the public purse. Please indicate the date when the ban was put into place.

Thank you for contacting Buckinghamshire County Council.

We are sorry, but on reviewing your request we are not quite sure what is the information that you require.

We did wonder if you are seeking a list of homes that are suspended where we continue to pay for some residents that are still cared for within a suspended home (if we suspend a home it does not necessarily mean that we move all service users out, a service may continue to be received)?

If that is the basis of your request we would unfortunately not be able to assist, as I understand that we believe that such a list would be commercially sensitive. The following might assist to provide context:

Bucks County Council have closely aligned their suspension policy to inspection results from CQC and automatically suspend a provider if a rating of ‘inadequate’ is given to them. This is regularly reviewed against any resultant action plan and the suspension will be lifted if the Council is satisfied that the reasons behind the inadequate rating have been rectified. The Council does not wait until the ‘inadequate’ rating has been reviewed by CQC in order to lift the suspension. It should also be noted that the Council will also suspend providers for issues around safeguarding, contract monitoring and breach of contract. Such suspensions will be lifted once the issues causing the suspension have been remedied.
