information request of 3 September 2018. Aberdeen City Council (ACC) has
completed the necessary search for the information requested. Our response
is now detailed below.

 

Please supply a list (spreadsheet or similar is fine) of all council
housing under your remit. Please also supply a list of ex-council housing
(ie properties bought out under right-to-buy etc).

ACC is unable to provide you with information on a list of all council
housing under your remit and a list of ex-council housing as it is
excepted from disclosure. In order to comply with its obligations under
the terms of Regulation 13 of the EIRs, ACC hereby gives notice that we
are refusing your request under the terms of Regulation 11(2) in
conjunction with 11(3)(a)(i) – Personal Information - of the EIRs.

 

In making this decision ACC considered the following points:

 

ACC is of the opinion that Regulation 11(2) applies to the information
specified above as the information in question is personal information
relating to living individuals, and the applicant is not the data subject.

 

ACC is of the opinion that Regulation 11(3)(a)(i) applies, as ACC
considers that disclosure of this information would be a breach of the
‘lawfulness, fairness and transparency’ principle. Third parties would not
expect ACC to release this information about them into the public domain
under the EIRs (or the Freedom of Information (Scotland) Act 2002
(FOISA)).

 

Aberdeen City Council owns over 22,000 housing properties and there have
been approximately 7,460 right-to-buy sales since April 1998. To provide
this information, we would need to seek consent from all individuals who
reside in one of those properties as we consider at this point that these
individuals do not have a reasonable expectation that this information
will be released. By releasing address details of properties owned by us
in which an individual resides, we would be identifying elements of that
individual’s personal and private life (i.e. that they are council tenants
and not private owners). By releasing address details of properties sold
by us under right-to-buy in which an individual resides, we would be also
be identifying elements of that individual’s personal and private life
(i.e. that they are private owners and not council tenants). ACC consider
that this would be a breach of the Data Protection Act 2018.

There are however categories that do not need to be published. An extract
is noted below:

 

Land which need not be included in the register

 

7.9. The Act allows the Scottish Ministers to make regulations specifying
types of land that relevant authorities need not include in their
registers. Following consultation and discussion with various relevant
authorities, a number of types of land have been specified in the
Community Empowerment (Registers of Land) (Scotland) Regulations 2016.

 

e) Houses, hostels and lodging-houses. As with roads, including all houses
would make registers much larger and more difficult to maintain and
search. There are also concerns about the privacy of tenants and security
for accommodation for vulnerable people. Community bodies do not often
want to take over houses that are occupied, and special arrangements would
apply if they wanted to transfer social housing to a new landlord.

 

If it helps, we released the attached information in relation to a recent
request. This covered all properties from which waste and recycling was
collected. Please let us know if this would satisfy your request?
