List of council housing addresses

Please supply a list (spreadsheet or similar is fine) of all council housing under your remit.
Please also supply a list of ex-council housing (ie properties bought out under right-to-buy etc).

Thank you for your request for information.
Unfortunately I am unable to provide the information you have requested as
the information is exempt from disclosure under Section 40(2) of the
Freedom of Information Act 2000. I have set out the Council's position
below:
A list of all council housing under the Council’s remit
Please find attached a list of street names and post codes of the Council
houses under the Council’s remit. Please note, all properties which are
used to house individual’s requiring protection in a secret or
confidential location have been removed. From this information you will
be able to locate the areas within Exeter where there are Council houses.
I am unable to provide the flat or house number of the properties as the
full address constitutes personal data within the definition of the Data
Protection Act 2018 (DPA 2018). Disclosure of such information would
breach the DPA 2018. The Council considers that it would be unfair and
unlawful to release the information without redaction, and there is no
legitimate interest in the public knowing the information without
redaction.
The qualification criteria set by the Council includes homelessness and
other significant housing need(s), would allow individuals to be
identified as members of a vulnerable group. The flat or house number of
an individual property, taken together with the electoral roll information
and the qualification criteria for housing set by the Council.
The Council believes individuals who have been housed by the Council would
have no expectation that the personal information held by the Council
would be provided to third parties, and would expect that the information
would only be used by the Council in relation to the administration of the
Council’s statutory housing duties.
For the reasons set out above, I am therefore unable to release a full
list of Council housing under the Council’s remit.
A list of ex-council housing
Ex-council houses have been purchased by individuals. Knowing the address
of a property makes it likely that the identity of the person living there
could be discovered using other sources of information such as the
electoral roll. Therefore this information constitutes personal data
within the definition of the DPA 2018.
The Council considers that disclosure of a list of ex-council houses may
result in unwanted contact from individuals of a commercial or
non-commercial nature and would therefore be in breach of an individual’s
right to prevent processing for the purposes of direct marketing.
The Council also considers that the individuals concerned would not expect
their personal data to be released in this way or used other than for the
administration of the Council's statutory housing duties.
The Council believes disclosure of this personal data would be unfair and
unlawful and there is no legitimate interest in the public knowing this
information.
For the reasons set out above, I am therefore unable to release the
information.
