List of council-funded women-only swimming sessions
Dear Adur District Council,
1. Please list all council-funded public swimming pools that provide 'women only' or 'ladies only' (or similarly described) swimming sessions in your local authority.
2. Which of the listed facilities that advertise 'women only' or 'ladies only' (or similarly described) swimming sessions, provide an environment that is exclusively single sex, i.e., for females only, and which facilities provide a session that is mixed sex, i.e., do not exclude males who identify as a woman?
3. Please send me a copy of the council policy or policies that cover the provision of 'women only' or 'ladies only' (or similarly described) swimming sessions.
4. Please tell me, do the council-funded leisure centres and sports facilities provide single sex changing rooms and showers in your local authority?
Yours faithfully,
F. McGinty
Dear F. McGinty,
Many thanks for your request. In order for you to make a valid request for
information, please provide your real name as set out in Section 8(1)(b)
of the Freedom of Information Act 2000 (FOIA).
For information, to be valid under the FOIA, a request must fulfil the
criteria set out in Section 8 of the Act.
8.—(1) In this Act any reference to a “request for information” is a
reference to such a request which—
(a) is in writing,
(b) states the name of the applicant and an address for correspondence,
and
(c) describes the information requested.
(2) For the purposes of subsection (1)(a), a request is to be treated as
made in writing where the text of the request—
(a) is transmitted by electronic means,
(b) is received in legible form, and
(c) is capable of being used for subsequent reference.
As you have only provided your first name initial and surname this does
not meet the definition of a ‘real name’. ‘Real name’ means, any variation
of the requester’s title or first name combined with their surname (e.g.
Mr Smith or John Smith) will be sufficient to meet this requirement.
However, a first name or surname provided in isolation, or a set of
initials, will not. A combination of the requester’s middle names and
surname will also be acceptable as this is simply another way of
expressing their real name.
Yours sincerely

Response:
The information you have requested is exempt under section 21 of the
Freedom of Information Act 2000 (FOIA) because it is reasonably
accessible to you, and I am pleased to inform you that you can access it
by searching the Councils' Disclosure Log for request number 21611975. You
can also search the disclosure log for key terms to find the information
you are
seeking: [2]https://www.adur-worthing.gov.uk/about-t...
Section 21 FOIA exempts disclosure of information that is reasonably
accessible by other means, and the terms of the exemption mean that we do
not have to consider whether or not it would be in the public interest for
you to have the information.
You can also find more information by reading the full text of the Act,
available at https://www.legislation.gov.uk/ukpga/200...
We have provided below some of the guidance we use when applying Section
21 FOIA.
Section 21 FOIA exempts information from the right of access if that
information is reasonably accessible to the applicant by other means.
It confirms that the FOIA does not provide alternative means of access to
information which is already freely available, either through commercial
publishing operations or through existing publicly funded provision. The
FOIA rights are designed to supplement, and not to duplicate, the usual
flow of information to the public through the commercial electronic and
print media, and through existing library and archive services.
We hope the information provided assists you.
Review procedure
If you are not satisfied with the response to your request for information
you have the right to an internal review. Details can be found on

Your request for internal review should be submitted to us within three
(3) months of receipt by you of this response. Any such request received

to appeal to the Information commissioner’s Office (ICO), details of which
can be found here: [4]www.ico.org.uk/concerns
