We have not provided the machine numbers or serial numbers because we have
concluded that this information could be used to compromise the machines’
operating systems, which would be contrary to the Computer Misuse Act
1990. Section 31(1)(a) FOIA provides an exemption from a public
authorities duty to provide information upon request if its disclosure
under the Act would, or would be likely to, prejudice the prevention or
detection of crime. This exemption is qualified in that we are required to
weigh the public interest in us withholding the information against the
public interest in us making it available. We are permitted up to 20
working days in which to carry out this public interest test and we will
therefore provide you with our final decision by 12/7/2016, which is the
20 working day deadline.

Further to our email of 14 June 2016, we have now carried out the public
interest test in relation to your request for information. We acknowledge
that there is a public interest in the disclosure of much of the
information held by public authorities. This serves to ensure transparency
and accountability in the use of public money and the way services are
provided. Such transparency promotes public understanding. An informed and
involved public helps to promote good decision making by public
authorities; thus helping to secure the best use of public resources.

 

However there are occasions where it is appropriate not to release
information upon request. When considering requests for information where
a qualified exemption has been applied, we have to recognise that
disclosure under the Freedom of Information Act is considered to be made
to the public at large and not just to the individual requester. We have
taken into account that the requester’s private interests are not in
themselves the same as the public interest and that what may serve those
private interests does not necessarily serve a wider public interest.
Also, that what may be of interest to the public should be distinguished
from what is in the public interest.

 

We have considered this issue and have concluded it is in the public
interest that the County Council’s finances and revenue streams are
protected from potential compromise and that the public authority is able
to maintain its services. We have also concluded that it is in the public
interest that they be protected from the effects of potential fraud. We
will not be releasing this information.
