Hello,

Thanks for your reply. Unfortunately I had already checked the downloads available on your website before filing the FOI - they only have an extremely broad location classification for ONS region and ACE region codes, and I need exact location information such as address or latitude/longitude.

The data downloads also do not include any of the additional information I requested, if at all available.

Thank you for your email.

 

Arts Council England does not hold the data you are requesting centrally.

 

The list of accredited museums is available on our website, and up to date
museum addresses and website addresses will be published by each museum
therefore we are in part refusing your request under Section 21 of the
Freedom of Information Act. The ICO states that Section 21’s purpose is
“to ensure that there is no right of access to information via FOIA if it
is available to the applicant by another route”, and that “the information
must be reasonably accessible to the particular applicant”. Furthermore,
they state that “information available via the public authority’s
publication scheme will be reasonably accessible to an applicant”.

 

Under Section 12(1) of FOIA, the Arts Council England is not required to
provide information requested if the work involved in obtaining the
information exceeds an appropriate limit. The appropriate limit for public
authorities is £450 as defined in Regulation 3(3) of the Freedom of
Information and Data Protection (Appropriate Limit and Fees) Regulations
2004 (the Regulations). The guidance document Using the Fees Regulations
from the Information Commissioner’s Office states that the time limit is
exceeded if the time taken to determine whether we hold, locate, retrieve,
and extract the information exceeds 18 hours. This roughly translates to
two and half days work.

 

For Arts Council England to manually create such a list and consult with
each 1740 museums to ensure that the information is accurate exceeds the
appropriate limit under the Regulations. As a result, I am in part
refusing your request on the basis that it exceeds the appropriate limit.
The reason this threshold is in place is because the costs of responding
to Freedom of Information requests have to be taken from public funds.
Exceeding this threshold would therefore impact on other areas of spend.
By using our resources for a large single request, our ability to comply
with other requests that we receive within the requirements of appropriate
legislation would be severely impacted.

We hope you are satisfied with the way in which we have dealt with your
request for information under the Freedom of Information Act, however, if
you are not satisfied that this is the case then you are entitled to an

Hello,

Can you please reassess this, as I know the address for each museum must be supplied via Grantium during the application, so this information should be held centrally by the Arts Council.

I also do not believe Section 21 applies here, as the current Accredited Museum data published by the Arts Council only supplies the name of the museum as identifying information, and it is extremely difficult (if not impossible) to actually find the requested information about some of the smaller museums with this alone.
