This is my request under the Freedom of Information Act 2000.

For each of the last six years please state:

1) The names and addresses of all shops for whom Doug Simmons (ex chief of Sussex Police) procured licenses for with Brighton and Hove City Council.

2) The names and addresses of all shops where Doug Simmons (as above) acted ir order to obtain a license but the application was refused by Brighton and Hove City Council.

3) How many of these licenses were reviewed and/or revoked subsequently?

I am writing to request an internal review of Brighton and Hove City Council's handling of my FOI request 'Licenses obtained by Doug Simmons ex Chief of Sussex Police.'.

The contents of the reply are at odds with some of the information given in response to a previous request. You have already said that 158 licenses have been obtained by Doug Simmons acting as agent for other parties. There is no indication of what years these relate to and you must have this information to be able to give the details you have. I do not accept that you cannot provide the information as requested for the last 6 years.

At the same time, since there is a record of the applications made by Doug Simmons, it follows you must have information on applications that were refused, that is if there were any. In the event that no applications submitted by him were refused, then you should state that.

Please indicate the dates that apply to the licenses listed as being revoked etc.

Thank you for your email below appealing your recent FOI request.

 

We have carried out another search which comes up with the number but the
only details it gives relating to these are reference number, type
(whether new, minor application etc) and address.  

 

To provide the information you have requested would require us to
interrogate every individual record to identify names, premises names
etc.  It is estimated that this would take longer than the2.5 days allowed
for under the Freedom of Information Act.  In addition to this, once the
annual fee becomes due, the agent’s name is deleted from the case because
that record is where the annual fee renewal would be sent which would be
wrong – it needs to go to the premises.

 

I am sorry we cannot help further with your request.

I am writing to request an internal review of Brighton and Hove City Council's handling of my FOI request 'Licenses obtained by Doug Simmons ex Chief of Sussex Police.'.

I am surprised at your obfuscation in relation to my request for information relating to the Licenses obtained by Doug Simmons, either as agent, or in another capacity.

One of the items I requested was the addresses of the shops etc for which Doug Simmons obtained Licenses. This was requested at (1) in my request. Your response says that, "We have carried out another search which comes up with the number but the only details it gives relating to these are reference number, type (whether new, minor application etc)and address". So it is clear from that that you are able to supply addresses. Please do so without any further prevarication.

It seems probable that the name of each of the premises would be available as well as the address. I would ask you to reconsider this point and provide details accordingly.

Again, on the balance of probabilities, it seems likely that you would hold information on applications that were refused. Again, I would ask you to reconsider your response on this point.

This will be pursued via the ICO if there are further failures to comply with the FOI on the part of Brighton and Hove City Council.
