License for food without hand wash and toilettes facilities

Dear Leicester City Council,

Which department of Leicester City Council has granted a license to the family friendly restaurant McDonald's Market Street, Leicester LE1, to serve food, soft drinks, coffee, tea etc 24/7 and exempt them to provide hand wash and toilette facilities during the nighttime until 7am.
Everybody educated knows (?) and as well the Government department for health spend huge amounts of advertising money to inform the public when, how and in what way to wash theirs hands and the importance to avoid bacterial spreading and this family friendly restaurant refuse to let customers to wash their hands or use their existing toilets/washrooms before 7:00 am.

The Manager and the existing security personal inform the public that McDonald's is exempt from providing toilet and hand wash facilities during the time from midnight until 7:00am and they do not give any exception unless someone can provide a proof of disability to utilise their disability toilet.

It is a unacceptable situation that customer are refused to wash their hands or using McDonalds toilet facility when they feel the need to do so and the hygienic conditions are unacceptable and outraging especially since almost all provided food is consumed without the help of forks and knifes and that for are eaten with unwashed hands.

Which department of LCC is able to grant such a license because as well against all educational reasons, common sense, there is discriminatory reasons between able people, old or Iill, children, male or female non disabled guest of McDonald's happening - as well the absurd situation that someone with an amputated hand or foot is able to use the washroom facility and an old man or women is denied such possibility.

Your email below has been passed to me.

 

The late night licence does not exempt the establishment from providing
toilet and hand wash facilities during the time from midnight until
7:00am.

 

I visited the establishment and spoke to the manager. He told me that
between midnight and 7am the establishment operates not as a restaurant at
which people dine, but as a takeaway. He said that apart from out-of-city
sites and drive-throughs, this was McDonalds company policy.

 

Whilst the establishment is operating as a takeaway and not a restaurant
it is not obliged to provide toilet facilities.

Dear DavidBarclay Rhodes,

Thank you very much for your reply to my freedom of information request - and thank you very much for visiting the Restaurant McDonalds, Market Street, Leicester.

What you have seen during your visit at the daytime is the same business practise you would have seen if you would have visit the establishment during the night time from midnight to 7:00am! - Nothing would have been different to the daytime business - same food and drinks, same menus, prices and sitting arrangements - during daytime hours is only the first floor of the restaurant in addition to the ground floor opened and this part is closed from 19:00h to next morning 7:00am and there are the normal washroom and toilettes located.

The disabled toilet is downstairs next to the food serving area and is as well shut for the public from midnight to 7:00am - but open for Mcdonalds Customers from 19:00h till midnight without key or other restrictions.

You have been given misleading informations regarding change of status from restaurant to "take away business" and I am surprised that you fall for this con since it is obvious because tables and chairs are bolted to the floor and cannot be removed which would be a requirement for a typically takeaway business and furthermore there is no separation of space during "after midnight business" and on some business hours during the nighttime there are even more guests "sitting and dining" (with bare hands and unwashed fingers) than during daytime.

If you do not believe my explanation, so I suggest you visit yourself during nighttime the restaurant, alternatively I can provide you with photographic evidence if this is requested.

I trust that you will consider again your judgment over the status of this restaurant and look forward to your reply.

with reference to my reply from yesterday to your address, please find below some links from some pictures, which simply show that this establishment is in no way solely a takeaway restaurant. This pictures were taken by me this morning, 10th March 2015 at about 2am to 3am - there were as well an incident from sitting guests, were the police was called.

I hope now, that you will realised, that you were told the untruth when you have visited yourself McDonalds Market Street, Leicester and that it against all rules and regulations, that this business can operate in the way it does.
