Please could you release to me information on how many Licensed Betting Offices were licensed in Oxford in each year from 2007 to 2013.

For clarity: I wish to understand the total number of bookmakers licenced in each year 2007-13 and how that has changed over time. Some councils make their current register available online, unfortunately this gives just the current number not the historic trend.

Thank you for this response which consists of a list of all current gambling premises in Oxford. Unfortunately this was not the information requested.

In order to calculate the number of bookmakers operating in each year 2007-2013 additional information is required.

Firstly details of licences that were issued at any point from 2007 need to be included - along with the date of issue as well as a date that the licence was surrendered/lapsed or revoked.

Secondly the licence type needs to be clearly differentiated as the information supplied includes a mixture of bookmakers, bingo hall AGCs and the dog track.

Please could you look again at this request and provide the additional information requested.

Apologies if my initial question was in any way ambiguous or unclear.

I should add that maintaining this full register has been a statutory requirement under the 2005 Gambling Act since 1st Sept 2007 and so it is pretty certain that you do have this information.

I refer to your email below. 

 

All Section 156 of the Gambling Act 2005 requires is for the Council to
keep a register of all licensed venues. This is achieved by the online
Public Access, which you can access via the following link :

For your information Section 156 states:

 

156 Register

 

(1)A licensing authority shall—

(a)maintain a register of premises licences issued by the authority
together with such other information as may be prescribed,

(b)make the register and information available for inspection by members
of the public at all reasonable times, and

(c)make arrangements for the provision of a copy of an entry in the
register, or of information, to a member of the public on request.

(2)A licensing authority may refuse to provide a copy of an entry or of
information unless the person seeking it pays a reasonable fee specified
by the authority.

(3)The Secretary of State may make regulations about—

(a)the form of the register;

(b)the manner in which it is maintained.

(4)The Secretary of State may make regulations—

(a)requiring licensing authorities to give to the Commission specified
information about premises licences issued by them,

(b)requiring the Commission to maintain a register of the information
provided to it under paragraph (a),

(c)requiring the Commission to grant access to the register to members of
the public (without charge),

(d)requiring the Commission to make copies of entries available on
request, and on payment of a reasonable fee, to members of the public, and

(e)excusing licensing authorities, wholly or partly, from compliance with
subsection (1).

 

The information you are seeking is contained within the spread sheet sent
to you previously.  No licences have been surrendered or revoked since
they were granted.  The licence holder pays an annual fee, but does not
have to reapply every year to get a licence granted / renewed.

 

If you disagree with any part of the response to your request, you are
entitled to ask the Council for an internal review of the decision(s)
made.  You may do this by writing to the Monitoring Officer, by either
email – [2][email address] – or by post to Monitoring Officer,
Oxford City Council, St Aldate’s Chambers, St Aldate’s, Oxford, OX1 1DS. 
After the result of the internal review, if you remain dissatisfied, you

I am writing to request an internal review of Oxford City Council's handling of my FOI request 'Licenced Betting Offices in Oxford 2007-13'.

I have received information that relates to current licences but not information regarding when the licences were granted. I have also not received information for bookmakers alone but rather all gambling premises. This does not answer the question asked even though it is certain that you do hold this information as it has been a statutory obligation since 1st Sept 2007.

Of 326 English councils 317 have answered this request fully. In Wales 22 of 22 have and in Scotland 30 of 32 have. 14 managed to supply the information in full within a single working day.

The latest response from you claims that no bookmaker licences have been surrendered/revoked or have lapsed since 2007. This would be an astounding finding, it is not true of any other similar sized authority with a similar number of bookmakers. This final response was most unhelpful.

Please could you review this response and supply the information requested - which you do have within the statutory register.

I am a lawyer in the Council’s Legal Team working within the Law and
Governance Service Area.

 

You have requested an internal review of the response to your Freedom of
Information Act request concerning licensed betting shops. I have been
delegated by the Head of Law and Governance to conduct the review.

 

You requested information about the number of licensed betting offices in
Oxford between 2007 to 2013. You were supplied with the information
contained on the Council’s statutory Register of gambling premises kept
under section 156 of the Gambling Act  2005. The information was in the
form of a schedule showing the name of the premises and the date of issue
of the licence. You were also referred to the public access part of the
Council’s website which allows the details of individual premises licences
to be viewed.

 

Your request for a review alleges two deficiencies in the response
provided:

 

o “No information regarding when the licences were granted”
o “I have not received information for bookmakers alone but rather all
gambling premises”

 

The date of issue of licences is contained in the final column of the
schedule provided and is also contained in details on individual licences
available on the public access part of the Council’s website, the link to
which was provided in the response.

 

Whether or not the licensed premises is a betting shop/bookmaker is in
most cases self-evident from the licensed holder’s name on the schedule,
but should also be revealed by a search for the individual licence details
on the public access link.

 

I have been told by the relevant licensing officer that there are no
records of any gambling premises licences being revoked or surrendered
since the Council have been the Licensing Authority, nor have any lapsed
through non-payment of the annual fee.  The schedule provided shows all
current licences. The number issued each year and the year on year total
can be calculated by examining the date of issue column.

 

Therefore I believe the details you are seeking can be discovered from the
information provided and are also publicly available. I’m afraid the
Council does not have the resource, nor is it under any legal obligation
to do the research for you.

 

If you are not satisfied with the review, you may ask the Information
Commissioner to intervene on your behalf.  You may do this by writing to
the Information Commissioner's Office, Wycliffe Lane, Wilmslow, Cheshire,
SK9 5AF.
