Further to our acknowledgement, I can respond to your Freedom of Information Act 2000 request
received on 6th March 2023 as follows:
Your Request:
I would like to request a fully up to date HMO register for all Mandatory, additional & Selective licences
to include those submitted and awaiting approval as of this date.
Our Response:
Under The Licensing and Management of Houses in Multiple Occupation and Other Houses
(Miscellaneous Provisions) (England) Regulations 2006, Regulation 11, 1(1) the register is limited to "a
licence granted under Part 2 (HMOs) or 3 (selective licensing) of the Act which is in force". The use of the
words "granted" and "in force" means the Regulations exclude those applications which have been
submitted and are pending approval, so therefore we are unable to include these details on the register.
While the authority holds full data on pending license applications, the applicants have submitted this on
a confidential basis, only consenting to their details being made available if their application is approved,
and a license subsequently granted. Therefore, such pending applications are exempt from disclosure
under s41 of the Freedom of Information Act 2000 (Confidentiality).

For your information, with respect to current licenses, this email constitutes a refusal notice under
Section 17.1 of the Freedom of Information Act 2000 because an exemption under Section 21 of the Act
is being applied, namely the information is already in the public domain i.e. it is published online via the
Council’s website.
