(FOI Act) for information held by the Council which we received on
10/01/2009. You have requested the following information:

During the last five years how many times has the Local Government
Ombudsman (as a result of investigating a complaint against Kensington &
Chelsea Borough Council) brought to the attention of the council the fact
that a member of Kensington & Chelsea Borough Council staff had misled
them, lied to them or done anything else to hinder their investigation. If
they have what disciplinary action was taken against the individual(s)
concerned by the council.

Searches were conducted within the Council's Legal Department and I can
advise that we do not record this information in a readily accessible
format. It would require us to create this information in order to provide
it to the public, which is not required under the FOI Act. Therefore, for
the purposes of the FOI Act we do not hold the requested information.

Dear Sir or Madam,

Will you please confirm whether you have no record because the situation has never arisen, the response most other councils have given me. Or that it may have but you didn't bother keep any record. In addition you should be aware that it's the statutory duty of a monitoring officer to record such occurrences and bring them to the attention of your council. Therefore, the monitoring officer should have such information on record and within easy reach. There should be no reason to search every complaint.
