Dear Medway Council,

In April 2018

"Councils cannot set maximum budget levels when calculating the cost of people’s care, the Local Government and Social Care Ombudsman (LGO) has said following an investigation into a council that had a policy of placing people into bands, and paying in line with those banding levels, regardless of need. The LGO said Wiltshire Council’s approach was contrary to the Care Act."

Does Medway council accept the LGO's decision ?

Why are Medway council still limiting funding under the care act from £500-£1000 max ?

Is about a persons needs or Medway Councils banding levels?

"The Care Act says eligible needs must be met, regardless of the cost(LGO)", please provide the policy from Medway council that supports the LGO and carers.

Under the children's and families act , code of practice the tell us once approach is applicable , yet Medway council fails to accept this why?

Please provide details of direct payments policies to carers and the policy levels of £500-£1000 were the needs of the carer is taken into account.

Please provide a list of payments made to carers with (a)children under 18 (b) young adults over 18 in 2017 and 2018 and the criteria for the banding that Medway council uses ?

Does Medway council take into account the health needs of the carer? if so how , do you get reports ?

How does Medway council assess need of a carer?

What qualifications does the Medway council officer have to assess the need of the carer?

Why are Medway council not offering direct payments for carers, where they care for young people up to 18- 25?

Please provide details of list of all services available to carers , including respite care for children and adults within Medway.

Does Medway council accept that disabled children grow into disabled adults ? if so how do you provide respite care or services carers with young adults?

When offering services to carers does Medway council take into account the disabled persons needs and accessibility to be able to use the service ?

Who is responsible for the transition within Medway council ? from child to adult direct payments?

Does Medway Council accept that carers have may also have health concerns and need support . Please provide the policy

Yours faithfully,

Mr Breed
