Dear West Lothian Council,

(1) Please could you indicate the number of homophobic incidents targeted at pupils, reported in each of your schools (listed individually by name and number) that were reported in the 2016 - 2017 academic year?

(2) Please could you indicate the number of homophobic incidents targeted at staff, reported in each of your schools (listed individually by name and number) that were reported in the 2016 - 2017 academic year?

(3) Please indicate which of your schools have received staff training on dealing with LGBT issues and from whom (e.g. from a specific external organisation or the council).

(4) Please list which schools have either achieved Bronze, Silver or Gold, or are registered with LGBT Youth Scotland's School Charter Mark.

(5) For clarity and to put the above into perspective, please indicate the total number of schools in your council.

I refer to your request for information dated 17th June 2017, please see our response below;

(1) Please could you indicate the number of homophobic incidents targeted at pupils, reported in each of your schools (listed individually by name and number) that were reported in the 2016 - 2017 academic year?

Copies of these items have not been produced as the council considers these documents to be exempt in terms of Section 12 of the Freedom of Information (Scotland) Act 2002 on the basis that the cost of complying with the request would exceed the appropriate limit. Individual records would have to be interrogated.

(2) Please could you indicate the number of homophobic incidents targeted at staff, reported in each of your schools (listed individually by name and number) that were reported in the 2016 - 2017 academic year?

All school staff have received employee Equality and Diversity Training which was council led in 2016/17. In addition, Head Teachers have supported Equality and Diversity work in line with our Equality Outcome Plan. We also complete Stonewall Education Equality Index.

(4) Please list which schools have either achieved Bronze, Silver or Gold, or are registered with LGBT Youth Scotland's School Charter Mark.

Broxburn Academy have achieved LGBT Youth Scotland Silver Chartermark. Whitburn Academy, The James Young High School and Deans Community High School are working toward Bronze. In total 60 schools are registered.

(5) For clarity and to put the above into perspective, please indicate the total number of schools in your council.

You can apply to the Commissioner for a decision on the manner in which the Council has dealt with your request. The application must be submitted within six months after the date of receipt by you of the outcome of the Internal Review or in the event of the Council failing to comply with the Internal Review within six months of the expiry of the time period for compliance. The application should be in writing, email or other permanent format, state your name, address and the reason for your dissatisfaction with the original response and internal review. Should you then wish to appeal against the Commissioner's decision, there is a right of appeal to the Court of Session on a point of law only. Any such appeal must be made within 42 days after the date of intimation of the Commissioner's decision.
