(3) A copy of the policy relating to the investigation of complaints concerning a homophobic element, against a serving police officer or civilian in the forces employ,

(4) Details of LGBT bodies, groups etc that the authority liaise with, in order to ensure the needs of the LGBT community are being met.

The Police Authority does not hold any of the following information, the only complaints dealt with by us are complaints made against Chief Officers.

I will continue to forward this on to the constabulary for you, in hope that they will be able to answer your questions.

Your request will be considered in accordance with the Freedom of
Information Act 2000. Normally you should expect to be sent a response
within the statutory limit of 20 working days, subject to the provisions
of the Act. Unfortunately staffing in the FOI Unit is currently reduced
by two thirds and it may not be possible to meet the statutory limit.
Please be assured that all efforts will be made to meet the statutory
limit but if this is not possible late requests will be treated in
chronological order. The Information Commissioner is aware of the current
situation. If we are unable to respond to your request in time I
apologise for any inconvenience that this may cause.

2008, which was received by this office on November 18, 2008. I note you
seek access to the following information:

order to ensure the needs of the LGBT community are being met.

Following receipt of your request searches were conducted within Devon &
Cornwall Constabulary to locate information relevant to your request. I
can confirm that this constabulary holds the information you have
requested.

Extent of Searches to Locate Information
To locate the information relevant to you request searches were conducted
within the Diversity, Performance and Analysis and the Professional
Standards Depts.

Decision
I have today decided to disclose the requested information to you in
part.
The exemption applied is section 22(Information intended for future
publication) of the Freedom of Information Act 2000. The exemption has
been applied because the information that you request concerns policy
which is currently going through a process of being updated resulting in
its publication on the Force website.

Public Interest Test
Section 22 requires the application of a public interest test before it
can be claimed. Please see the attached document for details on how the
Public Interest Test has been applied.

I am writing to request an internal review of Devon & Cornwall Police Authority's handling of my FOI request 'LGBT Complaints'.

I am unsatisfied that the DCPA have cited section 22 exclusion without justifying that the public interest balance has been considered. I feel that owing to the fact that DCC have disclosed a number of officers involved in homophobic incidents, the policy as-is (as currently in force) should be disclosed.

I hope the information sent to Lord Mc Dowall by Devon & Cornwall Constabulary contains the following complaints which have been made by GLBT persons against Cornwall police.

All of which complaints were made, but have NEVER properly been investigated, or were covered up or were ignored by Devon & Cornwall Constabulary & the equally biased IPCC (in favour of the police).

These complaints are merely tip of the iceberg of continuing homophobic attitudes & practises embedded & protected within Devon & Cornwall Constabulary to my personal knowledge & experience.
