LG Act 1974 Part III Section 32(3) notices

The request was successful.

Dear Sir or Madam,

Over the last five years

(1) How many Local Government Act Part III Section 32(3) notices
has your council served on a Local Government Ombudsman.

(3) How many times has the Ombudsman concerned found the council
guilty of maladministration for misusing a Section 32(3) notice.

Yours faithfully,

Trevor R Nunn

Filus James, Hammersmith and Fulham Borough Council

Dear Mr Nunn

Thank you for your request for information in which you have enquired as to whether the Council has served the Local Government Ombudsman with a notice under Section 32 (3) of the Local Government Act 1974 in the past five years.
In response to your request, I can confirm that the Council has not served such a notice over the period you have requested.
The Local Government Ombudsman has not issued a maladministration decision against the Council within the period you have requested information for, and therefore would not have reason to publish information that could possibly lead to such a notice being served. Furthermore, disclosure of information by the Ombudsman is normally a consultative process, with the Council being offered an opportunity to comment prior to any disclosure; as such, it is unlikely that serving such a notice would ever be considered necessary.
I hope this information proves helpful. Nevertheless, if you are dissatisfied with my response, you may complain to the Information Manager, Business Technology, 6th Floor, Hammersmith Town Hall Extension, London W6 9JU.

Once you have exhausted the complaints procedure you may appeal to the Information Commissioner's Office, Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF, Telephone: 01625 545 700, http://www.ico.gov.uk
