We will not, however, publish personal information if this would be unfair and so breach the first data protection principle. We will, however, disclose the identity of requesters if this is in the public interest and doing so would be fair, such as in the case of holders of public office. I am writing in response to your request for information dated 28 June
2019 in which you requested information regarding letters sent to Merthyr
Tydfil County Borough.

 

For ease of reference, I have reproduced your question below and set out
our corresponding response.

 

I request copies of the letters sent to Merthyr Tydfil County Borough
Council, in relation to financial and management issues, covering the
period of the 1st April 2019 to present.

 

We hold some information matching this description. This includes the
annual audit letter issued on 07 April which is already in the public
domain and available on the Council website at:

Accordingly this information is reasonably accessible to you by other
means and is exempt from disclosure under section 21 of the Freedom of
Information Act 2000.

 

We also hold a copy of the letter dated 31 May 2019, issued to the Leader,
Councillor Kevin O’Neill and a copy of that letter is attached. I have
redacted the signature from the letter under the exemption at s40(2) of
the Freedom of Information Act 2000 as disclosures under the Act are into
the wider public domain and I consider that release of this information
would not be within the reasonable expectation of the individual
concerned. As such, the disclosure is likely to be unfair and to disclose
would be a breach of the Data Protection Act principles.
