Dear Ms Berg,

Thank you for your reply to my freedom of information request and
in particular for the copy of the letter from Ofcom's David
Harrison, dated 9 November 2009, concerning HD on DTT content
management.

I am somewhat puzzled that Ofcom is refusing to release the letter
from the BBC's Graham Plumb to Ofcom's David Harrison, dated 20
November 2009, regarding Freeview HD transmissions interim content
management provisions; and that this information is being withheld
under sections 41 and 44 of the Act.

The BBC has already implicitly expressed a willingness to release a
copy of this letter but just cannot seem to locate one. See the
letter from Steve Gutteridge of 8th July 2011 at

(see in particular Mr Gutteridge's comment on row 5 of the table on
page 2 of the letter relating to Doc J12a).

So could I follow up:

(a) with a request that you ask the BBC's permission to release a
copy of Mr Plumb's letter which you are currently withholding

(b) enquire whether Ofcom has a blanket procedure of withholding
information that is "obtained by Ofcom from another person and the
disclosure of the information to the public (otherwise than under
the Act) by Ofcom would constitute a breach of confidence
actionable by that or another person"?

(c) point out (again) that section 393(1) of the Communications Act
2003 does not provide absolute immunity from disclosure. See
section 393(2,6,7,8 & 9) of the Act
