Thank you for your correspondence of 17 March 2017 in which you made a
request for information to the Information Commissioner's Office.
Your request read:
“Please may I have a copy of the letter which I understand has recently
been sent to Surrey and Sussex Healthcare Trust reminding them how to deal
with information requests”.
Response to request
In response to your request please find attached a copy of a letter sent
from our Performance Improvement Department to Surrey and Sussex
Healthcare NHS Trust dated 10 March 2015 concerning the handling of FOI
requests.
We have only redacted personal data from the attached letter in accordance
with section 40 exemption FOIA which relates to personal information. An
explanation of the application of this exemption will follow below.
The redacted information relates to an identifiable individual and as such
constitutes their ‘personal data’. We consider the disclosure of this
personal data to be subject to the exemption at section 40(2) of the
Freedom of Information Act 2000 (by virtue of s40(3)(a)(i)).
The disclosure of this personal data would not be within the reasonable
expectations of the individual concerned and as would contravene the first
Data Protection Principle. This requires personal data to be processed
‘fairly and lawfully’.

Review procedure

Dear Information Commissioner’s Office,
Thank you for this information. In the copy correspondence you have provided, the ICO expresses concern that Surrey and Sussex Healthcare incorrectly applied section 12 and that the Trust took an excessive length of time to reply to the ICO's correspondence. However, there is no mention of concern of the fact that the Surrey and Sussex Healthcare FOI officer gave incorrect information in the first place, or that the Director of Corporate Affairs attempted to apply section 14 when I queried the information given.
Could you please clarify whether or not these concerns have been raised with Surrey and Sussex Healthcare Trust in other correspondence relating to the case.

I have looked into your enquiry and can see that we replied to your
request on 14 April 2015, within the deadline You will also have received
a letter dated 24 April following your query of 17 April. This was our
final response to you about our correspondence with the Trust. We don’t
therefore believe there is anything outstanding for us to respond to.

Dear Information Commissioner’s Office,
I know that you answered my initial request, but I followed up with a further request for information which has not been answered - which in fact was acknowledged and then ignored.
As far as I am aware, the ICO has not expressed any concerns to Surrey and Sussex Healthcare that their FOI officer gave incorrect information and that the Director of Corporate Affairs attempted to apply section 14 when I queried the information given. My follow up request was asking you to confirm whether this is the case and I have not received a response.
My understanding of the FOI Act is that if you hold information and have not previously given it to me, I am entitled to ask for this information and you do not have the right to say you are not discussing the matter with me any further.
