Letter sent to sitting trial Judge.

J.C.M. Hughes made this Freedom of Information request to Department of Justice (Northern Ireland)

This request has been closed to new correspondence from the public body. Contact us if you think it ought be re-opened.

The request was refused by Department of Justice (Northern Ireland).

Dear Department of Justice (Northern Ireland),

On an undisclosed date between November 23, 2012 and January 20, 2015, Mr Joseph Mulhollad of Mulhollad & Co Solicitors, Co. Down, wrote privately to a Judge, hearing the case of Christopher Logue (solicitor) also of Mulhollad & Co.

The courts attention was drawn to this correspondence by Judge Nigel Broderick the implications of which were discussed further between Judge Broderick and QC Eugene Grant.

It is a matter of record that this letter was copied to the Offices of the Lord Chief Justice.
As such I believe that this is a publicly discoverable document and apply to receive sight of same under this FOI request.

Yours faithfully,

J.C.M. Hughes

Dear Department of Justice (Northern Ireland),

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Department of Justice (Northern Ireland)'s handling of my FOI request 'Letter sent to sitting trial Judge.'.

Your response recieved today, broadly makes two points...

A) that no requirement exists to confirm or deny the existence of such material.
B) the impact the revelation of such material may have on third parties.

In consideration of same please note that it is publicly recorded that this letter was sent to the LCJ. Furthermore the persons impacted by the letter and the incident which prompted it's creation are also all publicly recorded.

The refusal to grant sight of this letter is unacceptable and will be vigorously pursued by all legal means, should it not be forthcoming via the efforts of your office.

I therefore respectfully request an internal audit of this matter.

A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/l...

Yours faithfully,

J.C.M. Hughes
