Dear Worcestershire County Council,

May you kindly give me responses to the following:

1. What are the implications and protections for young People aged 16-18
in care proceedings who lack capacity
2. What are the 'exceptional circumstances' that apply to children aged
16-18 years under the Children's Act 1981
3. When is the Mental Capacity Act 2005 used over the Children's Act 1989-
when would a child require a capacity assessment
4. When do the Family Courts and the Court of Protection need to be
involved in mental capacity decision making.
5. Can you tell me the conflicts and dilemmas surrounding the Human Rights
Act 1998, Mental Capacity Act 2005 and the Children's Act 1989, which
piece of legislation takes precedent and why?
