When issuing documentation to the public attempts are made at all times to reduce legal terminology so that such correspondence can be understood.

Dear Craig Griffiths,

Can you confirm that the legal language of legal ease is used against the public?
Can you confirm that definitions of words in the legalese language are different from regular English?
This being the case, wouldn't the publics need for full disclosure and transparency be Paramount or does the maxim of... Let he who is deceived be deceived still stand?

If both parties do not have full disclosure and transparency wouldn't that be an unfair advantage and also deception? This would nullify any action, void abinitio... Void from the beginning.

As per previous responses from the Council I would respectfully inform you that the Freedom of Information Act 2000 requires public authorities, such as local authorities, to provide members of the public with access to “recorded information” held in permanent form by those authorities. The FOI Act does not place any obligation on public authorities to answer general questions posted to them and/or to provide comments on any specific matters.

The Council’s Head of Legal Services and Monitoring Officer is Mr Craig Griffiths.

As previously indicated to you, the Council does not have any policy in respect of the use of legalese and therefore there is no information that can be provided in this regard.

As indicated previously legal terminology is used as appropriate in formal documentation such as Court proceedings, contracts, conveyances and similar related documentation. When issuing documentation to the public attempts are made at all times to reduce legal terminology so that such correspondence can be understood, the Council favouring a clear and concise approach. Legal terminology does have its own unique meaning at times which can be slightly different to clear wording, hence the need to ensure that correspondence and documentation is readily understood.

In respect of other queries, the Council would respectfully inform you that in respect of the questions posed in your email, those questions are not “requests for recorded information” held by this Council. The questions posed are for comment and therefore outside of the requirements imposed on the
Council and if there are specific areas of concern you might wish to seek obtaining independent legal advice to answer any concerns you might have."

Further to your email received 10th January 2020, wherein you request that the Authority "Give examples of how legalese is used, explain how the language is used... Wording and definitions of legal terms that the council uses in legal documents as mentioned above", please be advised that the only part of that sentence which can be construed as a Freedom of Information request under the Freedom of Information Act 2000 is the following:-

"Give examples of how legalese is used".

We would inform you that the remainder of your request is not "a request for recorded information held by this Authority", it is in fact a request for the Authority to provide you with explanations and definitions. The Freedom of Information Act only provides members of the public with the right to obtain from Public Authorities "recorded information held by those Authorities"; it does not require Public Authorities to provide any explanations, opinions, expressions or definitions of words/phrases in response to requests received from members of the public in relation thereto.

Accordingly, in response to your FOI request to be provided with examples of Legal terminology used by the Authority (which you refer to as "Legalese") please find attached hereto an Order previously produced by the Authority which contains two examples of Legal terminology regularly used by the Authority. The two examples are highlighted in that document for your perusal. Please be advised that the Authority will not be explaining how Legal terminology is used or will it provide definitions of Legal definitions of such Legal terminology in response to your request : as there is no requirement for us to do so under the Freedom of Information Act 2000.

If you are dissatisfied with the response to your request, under the Authority's FOI Policy, you may appeal in writing setting out the reasons why you think the decision is erroneous. Please address any such appeal to the Authority's Deputy Monitoring Officer at the following address:-
