Legal process for a change in pay and conditions

Post Office Limited did not have the information requested.

Dear Post Office Limited,

Can you please supply me with the process you follow for changing a subpostmasters contract eg payment received for processing a motor vehicle licence?

Is it just imposed, who agrees any changes on behalf of subpostmasters, who agrees it's fair and reasonableness in contract terms.

Yours faithfully,

andrea west

Dear FOIA,

Only a recognised Trade Union may engage in a collective bargaining process on behalf of persons identified within a defined bargaining unit. The NFSP is not recognised by yourselves for collective bargaining purposes, by your own admission. In fact the NFSP is under notice that they are to be de-listed as a Trade Union.

Therefore the answer that you have given is not accurate, you are under no obligation within the Standard Contract to negotiate pay rates with the NFSP, and such references should be removed by amendment to the contract.
Therefore would you please answer my question accurately, do you impose pay changes upon Postmasters or do you negotiate them with the individual contract holder?

Yours sincerely,

andrea west

Dear Ms West

Post Office Limited considers that it has responded to your request for
information in our response dated 12 November 2013 with the above
reference;

For clarity I will reiterate our response:

You requested the following information:

Can you please supply me with the process you follow for changing a
subpostmasters contract eg payment received for processing a motor vehicle
licence? Is it just imposed, who agrees any changes on behalf of
subpostmasters, who agrees it's fair and reasonableness in contract terms.

We responded providing the following answer:

The majority of subpostmasters are engaged under a standard Subpostmaster
Contract for Services.  Under the terms of this contract, Post Office
Limited is obliged to consult with the National Federation of
Subpostmasters (NFSP) prior to revising the remuneration rates which are
set out in Remuneration Booklets.  These obligations arise out of the
contract between Post Office Limited and the individual subpostmaster and
not out of any separate agreement with the National Federation of
Subpostmasters.

I hope this has clarified the position in respect of our response.

Regards,

Dear FOIA,

Would it be easier to get my MP to demand an investigation into your relationship with the NFSP and the reasoning behind you encouraging subpostmasters to join a union that you knew full well had no power to negoiate on their behalfs but by doing so enabled Post Office ltd to save many millions of pounds in transaction payments.

Yours sincerely,

andrea west

Dear FOIA,

You have faiiled to respond so:

Please clarify your response. You state the NFSP is not recognised by yourselves as having collective bargaining rights so who do you negoiate contract changes with?
