Legal procedure concerning W.C.A.

Response to this request is long overdue. By law, under all circumstances, Department for Work and Pensions should have responded by now (details). You can complain by requesting an internal review.

Dear Department for Work and Pensions
1]Is there any time limit between a claimant being called for a Work. Capability. Reassessment?
2] Has there been any Government intervention or actions in the W.C.R.that effect the claimants experience?
4] What does D.W.P. do to ensure that all medical reports all other recorded information the claimant has provided D.W.P & their contractor A.T.O.S. & any other material relevant to the claimant you hold concerning the claim period of the claimants benefit information is secure ; safe & available to the claimant as well as any other such information you hold on the claimant?
5] What methods does your department use to ensure you have a accurate up to date & regular factual record of a claimants interaction with your department?
6] How do you ensure A.T.O.S. behavior when a claimant questions A.T.O.S behavior &
reports them to you?
7]What is the proper procedure, guidelines & Statutes that you understand A.T.O.S your
contractor will employ to ensure the claimants appointment for W.C. by telephone is progressed in the agreed manner?
8] If by telephone a claimant informs the D.W.P. & their contractor A.T.O.S they are unable to attend W.C.A. because A.T.O.S. had not complied with their contractual obligations re. W.C. Reassessment. appointment made by A.T.O.S being incomplete causes claimant to refuse appointment,& due to these issues the claimant wishes to complain what would be the departments response?
9] How long after receiving such information would the D.W.P. contact the claimant?
10] what would be the response of the department?
11] what measures are taken to ensure that all relevant documents & facts held by D.W.P
are made available for the W.C. Reassessment?
12] If a claimant is sanctioned by A.T.O.S. & this is accepted by D.W.P. which the claimant believes for many reasons some generic such as using labor market infraction to hide the fact A.T.O.S. had been unable to for-fill their legal contractual obligation to the claimants & D.W.P. to perform a proper audio recorded W.C. Reassessment over a extended period of time & instead denied benefit to the claimants for their verbal response of not being able to attend their hurriedly arranged appointment, should the claimant be
sanctioned for cancelling a such a appointment?
13] Is there a contractual obligation between your department & a claimant?
