Dear The British Library,

How many publications in the UK have failed to comply with the Legal Deposit in 2015, 2016, 2017, 2018 and 2019? A whole number for each year is acceptable.

How many times has the British Library taken legal action in 2015, 2016, 2017, 2018 and 2019 to enforce the Legal Deposit legislation? A whole number for each year is acceptable.

What was the success rate for enforcing this legislation in each year?

If no legal action was taken to enforce the Legal Deposit legislation, is this because the cost of enforcement was greater than the benefit received?

Yours faithfully,

Mr Scott

Dear Hughes, Stephanie,

Thank you for your response. However there is some conflicting information in your answer.

1) How many times has the British Library taken legal action in 2015, 2016, 2017,
2018 and 2019 to enforce the Legal Deposit legislation? A whole number for
each year is acceptable.
The British Library has taken no legal action between 2015 and 2019 to enforce the
Legal Deposit legislation

2) If no legal action was taken to enforce the Legal Deposit legislation, is this because the
cost of enforcement was greater than the benefit received?
This is not applicable as we have enforced legal deposit legislation.

Can I just ask you to clarify how the British Library has enforced the legislation without taking legal action, civil or otherwise? The answers to 1 and 2 above are, to me, contradictory.

Yours sincerely,

Mr Scott

Dear Mr Scott,

Thank you for your email. I sincerely apologise for the typing error

To clarify, question two should read as follows-

2) If no legal action was taken to enforce the Legal Deposit legislation, is this because the cost of enforcement was greater than the benefit received?

This is not applicable as we have not enforced legal deposit legislation.

Once again please accept my apologies.

Kind regards

Stephanie Hughes

Dear Hughes, Stephanie,

Good morning! Thank you for your prompt clarification. We all make typos. However, as no enforcement action has taken place, Question 2 does apply. As no enforcement action has been taken to enforce the Legal Deposit, is this because the cost outweighs the benefits? A Yes/No answer is absolutely fine.

Cheers!

Yours sincerely,

Mr Scott

Dear Mr Scott,

I apologise for the delay.

You asked us -If no legal action was taken to enforce the Legal Deposit legislation, is this because the cost of enforcement was greater than the benefit received?

The reasons for apparent non-deposit in this calculation vary: for example, sometimes the works are straight reprints and so are not normally in scope and sometimes they were in fact never published, though their publication had been announced. For those which have genuinely not been deposited we have not enforced legal deposit legislation because of the expense of doing so overweighing the benefit and because of our wish to work constructively with the publishing community.

Yours sincerely
