Hi,

I think because of time/cost limits it will need to be in the name of EHRC - unless of course that provides a nil value and including the interventions and advice falls within limit?

I think you are better placed to advise on that?

Yours sincerely,

Louis Goddard

Freedom of Information, Equality and Human Rights Commission

Dear Louis,

Further to my last email requesting for further clarifications, you may refer to the following cases in which the EHRC has powers over, hope this will help you in deciding the types of cases that you are enquiring:

The Commission has the following powers relating to the courts:

1.to provide legal assistance to victims of discrimination (s. 28 Equality Act)
2.to intervene in or institute legal proceedings for discrimination (s. 30 Equality Act);
3.to intervene in or institute legal proceedings for human rights (s. 30 Equality Act);
4.to institute or intervene in judicial review proceedings (s. 30 Equality Act); and
5.to make applications to court for injunctions or, in Scotland, interdicts (s. 24 Equality Act).

Furthermore, if you are worried that your original request would exceed the time/cost limit under S12 of the FOI Act, you may consider refining your request to cases brought in EHRC's own name only, since there is a high possibility that going through files and records from the past 10 years may take more than 18 staff hours and hence exceed the £600 cost limit, please confirm.

Hope this helps.

Yours sincerely
