Legal Agreement for the HDV to guarantee a 'Right to Return' for tenants

Please provide details of any clause or provision in the draft Members' Agreement between the Council and Lendlease to establish the Haringey Development Vehicle (HDV), or any of the associated legal or business agreements to be agreed with Lendlease, that guarantees tenants whose homes are demolished by the HDV, under any stage of the HDV, a right to return to a new tenancy on the same estate after it has been developed, on the same terms and conditions, including security of tenure and rent, that they previously enjoyed.

Or, if there is no such clause in the draft legal agreement between the Council and Lendlease that would provide this guarantee, please confirm this.

Thank you for your request for information received on 13 November 2017,
in which you asked for the following information:

Council and Lendlease that would provide this guarantee, please confirm

My response is as follows:

 

The obligations of the HDV to existing Council tenants are set out in
section 10 of the Land Assembly Agreement, one of the legal agreements
considered by the Council’s cabinet in July 2017 [1](Land Assembly
Agreement).  This states the rights of tenants, and the relationship
between the HDV and the Council’s Estate Renewal Rehousing and Payment
Policy (ERRPP).  It clear about the right of return, in paragraph 10.1.1. 
The Land Assembly Agreement will be updated before signing – to reflect
the fact that a final ERRPP has been adopted by the Council, and to
clarify some of the issues raised in the definition of ‘Qualifications’ in
the Agreement – but the underlying commitment to tenants will not change. 
The final Land Assembly Agreement will be published once it has been
agreed and signed.
