Legal advice sought or received in relation to Down Stream Access

In allowing Royal Mail postmen to carry competitors' mail through Down Stream Access (DSA) what legal advice did Postcomm seek or receive ,if any, regarding the EU Charter of Fundamental Rights and any potential breach of this Charter.

Dear Mr. Stanley

Thank you for your Freedom of Information request. We did not seek or
receive any legal advice regarding the EU Charter of Fundamental Rights in
relation to downstream access. However, as with all our decisions we
consulted and took a wide range of views into account before making our
decision.

By way of background the first access agreement was negotiated between
Royal Mail and UK Mail in 2004. Royal Mail handled 6.4 billion items in
2009-10 through access agreements, which makes up about a third of Royal
Mail's inland addressed mail. If there is anything else you need please

explanation of access that you may find useful.

I hope you find this information useful however if you are unhappy with
the service you have received in relation to your request and wish to make
a complaint or request a review of our decision, you should write to
