Dear Norfolk County Council,

I am emailing to make an FOI request. Please provide the following information for all departments within NCC including Adult Social Services, Childrens Services, Community and Environmental Services, Finance, Fire and Resources:

1) the grade, job title and department of any staff member who currently has any car funded wholly or in part by your organisation.

2) for each member of staff, I would like to know the make, model, plate
year e.g. 66 of the vehicle along with the monthly or annual charge to the council for the vehicle.

3) Copies of any policies that relate to Lease Cars within the organisation with reference to specific makes and models available or funding levels/rates available, including any unique departmental deviations from the corporate policy.

This request is similar but different to a previous request against reference ENQ294303 and is requesting updated data and additional information. If this information is published online, please refer me to the source.

Please note that document Q3 ENQ 364814 Full terms and conditions
attachment applies to our new contract hire car lease scheme, so this is
an update from the previous information provided over 2 years ago.  The
cars are no longer owned or purchased by Norfolk County Council and staff
can chose vehicles with outlined restrictions.  A staff price list is
therefore no longer applicable, as staff monthly costs are unique to each
applicant.

Thank you for your prompt response to my enquiry.

There may have been some confusion in the interpretation of point 2 of my reqeust.

2. for each member of staff, I would like to know the make, model, plate
year e.g. 66 of the vehicle along with the monthly or annual charge to

Although you have provided the information requested it is not correlated and the wording of "for each member of staff" was intended to request the vehicle details associated with each member of staff.

Please could I request that information is provided as orginally intended.

You have confirmed that the information you requested has been provided,
however you have requested that the information be correlated in the
following way:-
 
•       You would like to know the vehicle details associated with each
member of staff.
 
Your request has been considered and is refused under Section 38 of the
Freedom of Information Act 2000 (the Act).
 
Section 38 (1) of the Act provides a qualified exemption for release of
information if its disclosure would, or would be likely to, endanger the
physical or mental health of any individual or endanger the safety of any
individual. In accordance with the Freedom of Information Act 2000 (the
Act), this letter acts as a Refusal Notice
 
The exemption applies for the following reasons:
 

* We believe that to release the information in this format, for each
member of staff, could place individuals in danger of harm.

 
Public Interest Test Reasons
 
The Council has considered whether the public interest is maintaining this
exemption is outweighed by the public interest in disclosure.
 
This Council has considered the following reasons in favour of disclosure:
 
o       Promoting accountability and transparency by public authorities
for decisions taken by them.
o       Promoting accountability and transparency in the spending of
public money.
 
Balanced against this are the following reasons against disclosure:
 
o       Releasing this information could place employees, their families
and other occupants of the vehicle in danger of physical and emotional
harm and could compromise their safety which is not in the public
interest;
o       It is not necessary to disclose this information to enable the
public to understand and hold the authority accountable for its spending
or decision-making
 
 
On balance the Council considers that the public interest in maintaining
the exemption outweighs the public interest in disclosure.
